A large coalition to raise the tipped minimum wage was launched at the State House with a press conference and public testimony on House Bill 5364. Representative Aaron Regunberg introduced the bill that would gradually increase the the minimum wage from $2.89 to match the regular minimum wage by 2020. Senator Gayle Goldin introduced matching legislation on the Senate side. There has been no increase in the tipped minimum wage in nearly 20 years.

ROC United RI (Restaurant Opportunities Center) launched “One Fair Wage Rhode Island,” an impressive coalition of community, labor, faith business and women’s organizations that includes the Women’s Fund of Rhode Island, RI-NOW, NAACP-Providence Branch, Farm Fresh Rhode Island, the Economic Progress Institute, the Bell Street Chapel, Rhode Island AFL-CIO, the Coalition of Labor Union Women, Rhode Island Jobs with Justice, Fuerza Laboral, NEARI, United Service and Allied Workers of Rhode Island, Planned Parenthood of Southern New England and Unite Here Local 217.

Many restaurant patrons are unaware that their tip is not simply a “thank you” for great service, said Senator Goldin, “It’s paying your server’s base salary, and nobody’s base salary should entirely depend on a customer’s mood.”

More than just being an issue of fairness, this is an issue of impacting “women’s economic security,” says Women’s Fund Executive Director Jenn Steinfeld. “Nearly three in four Rhode Island tipped workers are women, one-third are mothers, and more than half of these are single mothers.” Steinfeld says that eliminating the tipped minimum wage will “help address the gender pay gap.”

DSC_1784Being dependent on tips for their salary makes servers more vulnerable to sexual harassment, since telling a customer that their advances or flirting is unwelcome puts the server at risk of losing a tip. A recent report from the national ROC United found that, “Women living off tips in states with a $2.13 an hour tipped minimum wage are twice as likely to experience sexually harassment than women in states that pay the full minimum wage to all workers. In fact, all workers in $2.13 states, including men, reported higher rates of sexual harassment, indicating that the sub-minimum wage perpetuates a culture of sexual harassment.” It’s in response to this atmosphere of sexual harassment that ROC United has launched its “Not on the Menu” campaign.

There is also good economic sense in raising the tipped minimum wage, maintains Mike Araujo, of ROC United RI. “”Raising the subminimum wage will have an important stimulative effect for Rhode Island. When tipped workers earn more, that money goes right back into the local economy.” ROC United estimates raising the wage will pump $64 million into the state’s economy. Further, tipped workers in Rhode Island currently receive $638,325 in food stamps every month, which means that taxpayers are effectively subsidizing the restaurant industry through social welfare programs.

After the press conference there was a heaing on Regunberg’s bill in the House Labor Committee. Though over 150 people signed up to testify, on both sides of the issue, in the end only 25 people could endure the four hour hearing waiting for their turn to speak. Those speaking against raising the tipped minimum wage were mostly members of the Rhode Island Hospitality Association (RIHA), a business lobbying group that routinely opposes any legislation that might raise the minimum wage or improve the ability of workers to collect money lost to wage theft. Many  of the RIHA members wore small golden pineapple pins.

“The states that have eliminated completely their subminimum wage,” said Representative Regunberg describing the economic impact of his bill, “have as high or higher industry and  job growth rates as subminimum wage states.”

Bill Kitsilis, of Angelo’s Palace Pizza sees no reason to raise the tipped minimum wage, and said, “My tipped employees… are some of the highest paid employees in my business.” He thinks $2.89 is fine, since that’s what he predicated his business model on. Comparisons with other states are not valid, Kitsilis maintains, because other states have much, much stronger economies.

Representative Antonio Giarrusso asked about employee turnover. Kitsilis feels that turnover only happens when people aren’t making money, and he also says that there are a lot of people hiring right now, making it difficult to find workers. An odd statement, considering Rhode Island’s unemployment rate.

The issue of “side work” came up, that is, the work servers do for a restaurant, at $2.89 an hour, that doesn’t earn the server tips. Side work is an old way of getting work done in a restaurant on the cheap, and is completely legal. Raising the subminimum would eliminate this disparity. Kitsilis said that such work “tends to be… a small percentage of what they do, most of the time…”

Representative Teresa Tanzi has worked in the restaurant industry for 14 years. “In those 14 years I have worked at dozens of restaurants, somewhere around 45 restaurants, I would say. And in all those restaurants, one has paid me according to the law.” For fear of retaliation, she could never confront management about this. “I’m well aware that they are breaking the law, but there is nothing I can do. I am relying on my manager and the owner of that restaurant for my employment.”

The Department of Labor surveyed 9000 restaurants over two years and found that 84 percent of them violate the law.

When Chairperson Joseph Shekarchi pushed back against Tanzi’s experience, saying that he doesn’t see the connection between low wages and harassment and abuse of servers, drawing on his experience as a bartender, Tanzi stuck to her guns and pointed out that the experience of women working as servers and men working as bartenders are very different. “It does happen and it’s a daily occurrence. If someone touches you, or if you’re waiting on a table and it’s a party of ten and that’s all the money you’re going to make tonight, and they want to be fresh with you in some way shape or form… I refer to it as a ‘golf clap’ in my vernacular. Whenever someone says something that’s ‘funny,’ you’re waiting on someone and they something that isn’t funny, you have to laugh. If someone touches you inappropriately, what are you going to say? There’s very little recourse as a server that you have.”

Rep Giarrusso’s solution for “any woman or anybody getting sexually harassed” is that “they should hit somebody with a nine iron.” Maybe he’ll introduce legislation to that effect.

“The truth is, 60 percent of restaurant workers in Rhode Island are over the age of 24 and 32 percent of all of Rhode Island’s restaurant workers are parents.”

“I feel that the current wage devalues me as an employee,” says Daniel Burke. Burke explained how the days and hours he is making good money from tips are averaged with the days and hours he’s performing other tasks at the restaurant. As long as he averages minimum wage with the money provided by customers, the restaurant can get away with paying him $2.89 an hour. Of course, Representative Giarusso thinks that Burke should take this issue up with his employer because, “I would, that’s for sure.”

As a 31 year old mother explains that her bartender job requires her to perform duties that are not directly related to serving customers. Therefore no tips can be expected and the restaurant gets away with paying employees $2.89 an hour for work that any other business in the state would have to pay at least minimum wage to accomplish. Again, Representative Giarrusso misses the point, thinking that the issue of side work isn’t related to this. As long as there is a two-tiered wage system, restaurant managers and owners will have an incentive to make workers do untipped work at the lower wage, rather than pay the server properly.

ROC United RI’s Mike Araujo finally explains that “those extra tasks,” that is side work, are “built into the job.” Side work, prep and cleaning averages out to about 3 or 4 hours a day, which is “effectively unpaid labor.” This profitable industry is built on the backs of primarily underpaid women.

Araujo may have summed up the night best when he said, “This issue speaks to how we believe society should be shaped. Do we believe that our citizens deserve equal treatment and deserve full equality, or do we believe that there is a second tier that women, increasingly, belong to?”

“When we talk about this issue we can’t escape the fact that this is a women’s issue… forcing a worker to rely on tips for any portion of their base wage significantly increases their chances of experiencing sexual harassment.”

Once again, Representative Giarrausso claims that “I don’t really understand the connection to sexual harassment… If someone’s a jackass, for lack of a better word… I mean, I don’t promote sexual harassment. I think those people should be tied up and jailed and never come out.” Giarrusso claims he “can’t draw the parallel” between low pay and sexual harassment.

But Giarrusso tips his hand as he grins and asks, “Is there an acceptable level of sexual harassment depending on how much you’re getting paid?” This is simply a variation of the line, variously ascribed to George Bernard Shaw or Winston Churchill, “We know what you are, we’re just haggling over the price.”

In response to testimony quoting FDR, Rep. Giarrusso maintains that “there is data that shows that every time minimum wage goes up, so does unemployment.” The US Department of Labor dispels that myth at the top of its page on the minimum wage. Giarrusso also brings up the specter of automation, as is done now whenever minimum wage increases are discussed. I deal with the automation argument here.

John Elkhay owns Ten Prime Steak & Sushi, Rick’s Roadhouse, XO Café, Luxe Burger Bar, and Harry’s Bar & Burger, as well as Veritas Catering. “Unlike the people who testified before me,” says Elkhay, “I actually live and work in Rhode Island.” I guess he wasn’t listening to the experiences of the four speakers who do live and work in Rhode Island. After telling the committee about how many employees he has and how much money they all make, he throws them under the bus, saying, “They don’t claim all their tips, by the way. That’s a sneaky little secret.”

“Don’t say that in this building,” says Representative Giarrusso, trying to make light of the comment.

Elkhay doesn’t blink. “Yeah, well, it’s the truth.”

“Who is here, in the industry, saying there is a problem?” asks Chris Tarro, owner of Siena Restaurant Group, answering “I don’t think there is a problem.”

“Don’t take my word for it,” he continues. Rather, he recommends going out to dinner and asking a server. But, “don’t ask if they want a raise, everyone would like one.”

Tarro thinks that the kind of retaliation employees face for stepping up to complain about their working conditions is somehow equivalent to the reaction of potential customers when they hear about the ways restaurants pay their employees and the ways in which many restaurants exploit their employees. “When I testified last time here,” says Tarro, “I got emails, I was on progressive blogs… there’s a penalty to us coming here.”

“I would like to give a nice big golf clap to Representative Tanzi and to anyone else who is trying to distract you from the issue at hand…” is as much as this sarcastic restaurant owner could say before being stopped by Chairperson Shekarchi, who advised not going after those who previously testified.

“I don’t want character assassination,” said Shekarchi, “It doesn’t help your cause.”

“I would suggest to you that twenty years… twenty years without a raise… I don’t think there’s anybody in this room that’s going to work for anybody for twenty years without a raise.”

Kristin Dart, speaking for Planned Parenthood, said that when women are paid more, they are better able to pay for essential medical care.”If I have to choose between food on my table and my annual health exam, I’m going to put food on the table.”

Speaking of her own experience as a server, she said that she was regularly told by her bosses that sexual harassment was “part of the job. If you want to make tips, then you have to be ‘nice’ to customers.”

Amy Barclay owns Simpatico in Jamestown. She’s worked her way up from being a server, pregnant with twins making $4500 a week to owning her own place.  She says, “This isn’t a gender issue. This isn’t a Planned Parenthood issue, this is a performance issue.” Barclay says, “I was great staff. I still am.”

Barclay has 15 core employees and 60 in season. “They beg for their jobs back,” she says, “and they should.”

Having worked in California, where there is no tipped minimum wage, and now working in Providence, Avi maintains that in California the restaurant industry is booming and that people in the restaurants out there have a greater feeling of teamwork. “It should be the employers responsibility to pay their employees, and not to pass that on to the customers.”

Ray Desmarais, of 99 Restaurants, sounded like he was blaming victims for for their harassment when he said, “For anyone to be harassed in the restaurant business, shame on them for allowing it. Leave and come work for me. Cause I’m a good guy and I’ll treat you well.”

Senator Joshua Miller says, “…there hasn’t been a minimum wage bill I didn’t love, until today, until this bill.” Miller feels this bill takes “important revenue away from some of my most valued staff.” He owns three restaurants with over 80 servers. Senator Miller, like Representative Giarrusso, sees no relationship between low wages and sexual harassment.

Justin Kelley said that “it’s time to raise the wage” in Rhode Island. Business models change, says Kelley, citing out the end of slavery, child labor and the eight hour day as examples. Compared to those changes, raising the subminimum wage should be easy.

“I think it’s a human rights issue,” says this restaurant worker from Olneyville, “I don’t care if your male or female, that minimum wage needs to come up.”

Bob Bacon is the owner of Gregg’s Restaurants and the president of the Rhode Island Hospitality Association. He frequently visits the State House to testify against bills that might increase a worker’s wage or strengthen a worker’s ability to not have their wages stolen. Bacon feels that the Department of Labor is doing a terrific job enforcing labor laws, and no new laws are needed. Servers make a “self-reported” average of $12.12 an hour, says Bacon.

Sam Bell, president of the Rhode Island Progressive Democrats, explained President Obama‘s support for increasing the minimum wage and for increasing the tipped minimum wage. “Raising the full minimum wage and the tipped minimum wage will help reduce poverty among women and families as well as make progress towards closing the gender pay gap.”

“Considering a tipped minimum wage increase… would cost ten percent of our current sales.” This begs the question: Is the entire profitability of the restaurant industry dependent on paying servers subminimum wage? Do restaurant profits come solely from underpaying staff? How do restaurants remain profitable in California, where there is no tipped minimum wage?

She finishes the evening’s testimony with, “we’re seeing servers being replaced right now with technology all over the world.”

As I’ve said before: technology like that is coming no matter what we pay our employees. The questions we need to be asking in the face of new technologies are bigger than minimum wage increases, such questions go to the heart of our economic system, and whether it’s sustainable in the long term.

‘Wage Theft Street Theater’ outside Gourmet Heaven

DSC_1243A protest outside the upscale downtown Providence deli Gourmet Heaven was scheduled for the same day that three workers filed a case in district court for non-payment of wages. Six more workers are expected to join the case later this week, alleging a total of $140,000 in unpaid wages over two years. The workers have organized through Fuerza Laboral and Rhode Island Jobs with Justice.

As they did during their last protest back in December, workers and protesters entered the restaurant to confront management about the unpaid wages. This time store manager Mohamed Masoud was in the store, but he declined to comment to the press. The police arrived quickly and moved the 30-40 protesters outside and onto the sidewalk without incident.

Outside the protesters picketed and chanted for about 30 minutes. Passersby were handed flyers informing them of the working conditions at the restaurant. The police were vigilant in making sure there was ample room for pedestrians to get through the picket line, at one point picking up my video camera and moving it, even though there was a four foot wide path available.

The highlight of the protest was some “street theater” in which former employees acted out the experience of being hired by Chung Cho, the owner of Gourmet Heaven, which started off with promises and handshakes, but soon devolved into physical abuse, unsafe working conniptions and stolen wages. The scene ended with Cho and his manager, Masoud, being hounded down the street by an angry mob of workers.

In Connecticut, Cho reached an agreement with the [Connecticut] Department of Labor to pay $140,000 in back wages to 25 workers, but has so far not made his payments in a timely manner. Former employees of the two Gourmet Heaven stores in New Haven, CT have already filed suit against Cho in federal court in Connecticut for wage theft at the New Haven locations.

“The only way for Cho to pay workers what he stole from them is for us to bring this to the public and let his clients know what labor rights abuses were going on at this store,” said Jesse Strecker, Executive Director of RI Jobs with Justice in a statement. “Since Cho has not given any response to the [RI] Department of Labor and Training or to us, we are filing in the courts and continuing our public protest.”

A December 2014 report by the US Department of Labor determined that wage theft in New York and California amounted to between $1.6 and $2.5 billion dollar a year and that “…affected employees’ lost weekly wages averaged 37–49 percent of their income.”

Donna Nesselbush has introduced legislation in the Rhode Island State Senate that would increase the penalties for wage theft, and give more options to workers seeking lost wages.  In the press release for today’s action Nesselbush says, “Theft of any kind is wrong, but wage theft is particularly disturbing because it is often perpetrated against the most vulnerable in our society, those who need their wages the most, even to survive.”

Speak-Out for Good Jobs & Quality Care at RI Hospital 039More than 500 people crowded into the meeting room of Our Lady of the Rosary Church on Benefit St in Providence for the Worker & Community Speakout for Good Jobs and Quality Care on January 17.  At issue was the contract negotiation between Lifespan/Rhode Island Hospital and General Teamsters Local 251 representing some 2,500 hospital employees.

Speak-Out for Good Jobs & Quality Care at RI Hospital 058According to Local 251, “As a non-profit entity, Lifespan and RI Hospital are supposed to put the healthcare needs of the community first. Unfortunately, management has taken cost cutting measures, causing shortages in equipment and staff that undermine patient care.”

Literature at the Speakout quoted a nurse, Aliss Collins, saying, “When we are understaffed, I cover 56 patients in three units. It’s not right for the patients or the employees.” There was a story at the Speakout of another nurse who was forced to buy her own equipment for measuring oxygen levels, because the hospital did not provide it.

Speak-Out for Good Jobs & Quality Care at RI Hospital 158Obamacare has allowed Lifespan/RI Hospital to take in an additional $33 million in net revenue last year, because so many Rhode Islanders are now covered under Medicaid. Yet rather than invest this money in patient care, Lifespan pays its “ten highest paid executives” more than $16.6 million in its last fiscal year, an average of $1 million more in compensation “than the average earned by CEOs of nonprofit hospitals nationally,” according to the union.

At the same time, hospital employees such as single mom Nuch Keller make $12.46 an hour with no healthcare coverage. Keller’s pay does not even cover her rent. She regularly works 40 hours or more per week, yet Lifespan continues to pay her as a part-time employee. And in case you missed it, Keller works at a non-profit hospital, and receives no healthcare.

Speak-Out for Good Jobs & Quality Care at RI Hospital 046The Speakout was intended to show community support for the workers of RI Hospital, and was attended by Representatives David Cicilline and Jim Langevin, as well as General treasurer Seth Magaziner. There were also representatives from many other unions and community groups such as Jobs with Justice, Unite Here! and Fuerza Laboral. Many religious leaders, including Father Joseph Escobar and Rev Duane Clinker, were on hand to show support.

It was hard not to feel that something new was happening at the Speakout. The level of community support and solidarity made one feel as if a union resurgence were imminent, which many feel is necessary if obscene inequality is to be combated.

It was Duane Clinker who helped put the event into perspective for me. He said that unions have often limited their negotiations to wages, hours and benefits, and health-care unions have long argued staffing levels, but “when/if organized workers really make alliance with the community around access to jobs and improved patient care – if that happens in such a large union and a key employer in the state, then we enter new territory.”

This struggle continues on Thursday, January 29, from 2-6pm, with an Informational Picket at Rhode Island Hospital. “The picket line on Thursday is for informational purposes. It is is not a request that anyone cease working or refuse to make deliveries.”

Wage theft leaves victims few options other than protest

DSC_9811The recent protest outside Juan Noboa’s Olneyville residence by restaurant workers claiming that they were owed thousands of dollars in unpaid salaries for work at his Café Atlantic restaurant has provoked conversation about the propriety of such tactics. Noboa, though his lawyer, denies any wrongdoing and claims that one of his children was “terrified” by the crowd outside his house. His lawyer added that dissatisfied employees should not “protest at a man’s home in the dark” and suggested that a suitable location for protest might be the now closed restaurant.

It is true that no one would be disturbed by a protest at a closed restaurant. For Noboa and other business owners accused of misconduct by their employees, such an event would be perfect, because the media would not cover it, and no one would have to hear the protester’s demands. Those targeted by such protests and their defenders like to point out that there are proper channels through which to make such complaints. The protesters outside Noboa’s home, with the help of Fuerza Laboral, did file complaints with the Rhode Island Department of Labor and Training, so we can all rest assured, it is argued, that once the system has run its course, justice will be served and Noboa will be compelled to pay, or not, depending on the Dept. of Labor decision.

Yet protests like these are not about one business owner who may have stolen wages from employees, or even about two restaurants (the other being Gourmet Heaven, located in downtown Providence and formerly on the East Side) that have closed suddenly, leaving their employees high and dry. These protests are about what Phoebe Gardener, a Community Organizer for Fuerza Laboral, called, “…a pattern of Providence-based food establishments intentionally cheating workers of their wages.”

Statistics on wage theft are difficult to find. At the Economic Policy Institute (EPI) it is estimated that nationally, wage theft, “is costing workers more than $50 billion a year.” To put that into perspective, the EPI notes that “All of the robberies, burglaries, larcenies, and motor vehicle thefts in the nation cost their victims less than $14 billion in 2012, according to the FBI’s Uniform Crime Reports.” Wage theft is at least three times more costly than all other forms of theft combined, yet our prisons are filled with conventional thieves, not duplicitous employers.

Surveys indicate that most victims of wage theft never sue and never complain to the government. “A three-city study of workers in low-wage industries found that in any given week, two-thirds experienced at least one pay-related violation,” reports EPI, emphasis mine.

Wage theft is widespread, extremely profitable and easy to get away with.

Workers at the low end of the pay scale, or who are socially vulnerable, such as undocumented immigrants or former prisoners, are frequent victims. Reporting the crime of wage theft takes time, time the working poor need to be working in order to survive.

There is little reason for employers to properly pay what they owe workers. If caught, an employer will be ordered to pay the workers what they are determined to owe and may be fined a “maximum civil monetary penalty” of $1,100.

So let’s revisit the tactics of protest.

DSC_9779Having protesters arrive outside your home at 6am to accuse you of theft with a bullhorn is embarrassing and may be even a little frightening for your family. The very possibility that this might happen should serve as a deterrent to any business owner in Providence who might be considering cheating employees out of the money owed to them. As the Fuerza Laboral press release stated, “Workers and allies are bringing the message that they must be paid in full immediately or else they will continue to bring public attention on Noboa and the other owners.” [emphasis mine]

Workers, who used to be all but powerless in these situations, are finding ways to shift the playing field. This doesn’t mean that workers suddenly have the advantage, far from it, but if workers continue to use such tactics, business owners will no longer be able to steal from their employees so easily. Now offending employers risk something much more valuable than money: Their public reputations and the respect of their neighbors and family.

Laws could be passed that strengthen the rights of workers and make it easier to file claims of wage theft. Fines and penalties for non-payment or underpayment of wages could be increased to the point where they act as real deterrents, rather than as a cost of doing business. Our legislature could enact legislation that makes it economically worthwhile for unpaid employees to pursue their rightful claims.

However, in the absence of thoughtful legislation that protects the rights of workers, public protest must fill in to loudly proclaim a simple truth: Workers have dignity and deserve to be treated with respect.

Juan Noboa, one of the owners of Café Atlantic accused of non-payment of wages by former employees, “denies that he hasn’t paid people proper wages,” said his lawyer Dawn Oliveri.

Further, Oliveri assured me that she knows Noboa as “a very respectable business man.”

She intends to fight the allegations made by Fuerza Laboral on behalf of workers who have claimed that Noboa owes thousands of dollars for work done at Café Atlantic, a restaurant Noboa opened in September of last year and then closed shortly after.

Oliveri questioned the tactic of protesting outside a man’s home in the early morning, telling me that Noboa claims that one of his children was awoken by the protesters and “terrified.” She added, “You don’t protest at a man’s home in the dark.”

Oliveri also questioned the using word “thief” by the protesters in describing their former employer. “I hope they can substantiate their case,” she warned.

Our short conversation revolved around tactics. In Oliveri’s opinion the proper place for the protesters to state their case was at the closed restaurant, located at 1366 Chalkstone Ave, where the alleged wage theft took place. She then added, “I have a lot of respect for civil disobedience and so does Juan.”

Complaints of non-payment of wages against Noboa and his partner, Jose Bren, have been filed by several employees with the Rhode Island Department of Labor and Training over the last few months. In one complaint, Edwin says he was hired to work in the kitchen and claims that he is owed $700.

“Juan said he would pay some of the beginning wages in cash but only paid part. [Noboa said] the checks were set up but he didn’t bring them on Friday and then another excuse. Tomorrow. Then for Sunday but no one showed up. That Monday Juan and Chino assured me that all would be there money wise on Wednesday nobody again then or that week until a meeting with Chino.”

Jared, hired to be a front line cook, says that he was paid for the first week but not thereafter. He claims to be owed $462.

Flor Salazar was hired as an administrative assistant and claims she is owed $7,332.50. According to the complaint she filed, payment of the money owed her, “was requested, but [Noboa] never replied in person, only by phone and he refused to answer. We asked for a meeting so we could come to an agreement and he refused.” [Spanish translation provided by Tony Houston]

A worker named Oscar says he is owed $7,803. He wrote in his complaint that when he tried to find out why he wasn’t getting paid, Noboa, “never gave a valid reason, he just disappeared and I couldn’t talk to him again after he closed [the restaurant] either by cell or text message but there was no answer.” Oscar adds that Noboa agreed that, “he would give [my payment] to me in time because he was just starting, but in the end he just decided to close and he said he would open in 3 days, and it never happened. I only ask that he pay me what he owes me.” [Spanish translation provided by Tony Houston]

In the end, the cases will be adjudicated by the Department of Labor, and official determinations will be made. I will follow up on this story as it develops.

Workers protest ex-boss’s home at dawn; demand $17,000 in unpaid wages

Juan Noboa 9857 About 40 people showed up before sunrise at Juan Noboa’s 23 Julian St. residence in the Olneyville section of Providence this morning to demand the payment of over $17,000 in back wages to six employees.

According to organizers, Noboa and his partner, Jose Bren, employed around 15 workers to help open Café Atlantic, a restaurant located at 1366 Chalkstone Ave. between August and September, 2014. Some employees worked up to 70 hours a week, but, according to organizers, “by September 28th, Noboa and Bren closed the restaurant just months after opening and walked away without paying workers their full wages.”

The workers have organized through Fuerza Laboral (Power of Workers) “a community organization that builds worker leadership to fight workplace exploitation.” They have filed complaints with the Rhode Island Department of Labor and have attempted many times to contact the owners with their concerns, but have received no response.

DSC_9790Juan Noboa was a volunteer for Buddy Cianci during his unsuccessful run for mayor last election. During the election Noboa reported Representative Scott Slater to the state police for possible voter fraud after taking video showing Slater, “leaving Kilmartin Plaza, a Providence high-rise for the elderly, with what looked like a ballot.”  The police investigated and cleared Slater of any wrongdoing. Slater issued a statement saying that he recognized the man filming him “as someone who had threatened him in the past.”

According to the Providence Journal, Noboa “is a convicted felon and has been arrested 10 times dating back to March 2000.”

This morning’s action follows last month’s protest outside Gourmet Heaven on Westminster St. downtown. “We see a pattern of Providence-based food establishments intentionally cheating workers of their wages,” said Phoebe Gardener, Community Organizer with Fuerza Laboral.

“It makes me so angry that I am doing everything I can to provide for my family and do my job the best I can and Noboa doesn’t care about anything but making money for himself,” said Flor Salazar, former employee of Café Atlantic in a written statement, “Some of us are single mothers and are barely getting by.”

After chanting in Noboa’s driveway and pounding on his door for about fifteen minutes, the Providence police arrived and moved the protesters onto the sidewalk and into the street. Protesters handed out fliers to neighbors accusing Noboa of theft.

Noboa never came to the door or showed his face in the window.

Gourmet Heaven 002Supporters, activists and former employees stormed Gourmet Heaven, an upscale deli on Weybosset Street in downtown Providence Friday. They say employees are owed more than $100,000 in back wages, as is the case at Connecticut delis under the same ownership.

The protesters entered the Providence deli at noon and temporarily stifled the business to the consternation of the manager on duty. “Get out!” she yelled.

“We’ll leave when you pay your workers what they are owed,” replied one of the protesters.

“What you’re doing is illegal,” said another.

Gourmet Heaven 004Gourmet Heaven is owned by Chung Cho, and he runs two other Gourmet Heaven outlets in New Haven, Connecticut. There was also a Gourmet Heaven on Meeting Street here in Providence, but it recently closed. In New Haven, Cho has been charged with “42 felony and misdemeanors” for wage theft, and was “arrested twice for discrimination and retaliation related to these claims.”

Labor activists here say Rhode Islanders are owed more than $100,000 in minimum wage and overtime pay. Phoebe Gardener, organizer at Fuerza Laboral, a workers’ rights center in Central Falls, has filed claims here in Rhode Island for seven workers.

After about five minutes of protest inside Cho’s downtown deli, the Providence Police Department arrived and the protesters left the store. But they continued to picket and chant outside Gourmet Heaven on the Weybosset Street sidewalk for the next hour, seriously impacting business. Flyers are distributed to passersby explaining the reason for the protest.

This protest was marked by excellent, artful signs and a few fun touches such as a rat mask and Hulk gloves.

In Connecticut, Cho reached an agreement with the Department of Labor to pay $140,000 in back wages to 25 workers, but has so far not made his payments in a timely manner. There are reports that the New Haven stores are in the process of closing.

Gourmet Heaven 017In November, Mohamed Masaud, manager of Weybosset Street Gourmet Heaven, claimed that there were no such violations going on in Providence.

Gardener and Jesse Strecker of Rhode Island Jobs with Justice, claim to have found ten workers who are owed thousands, or even tens of thousands of dollars in back pay. All told, it is asserted that over $100,000 in minimum wage and overtime pay is owed to workers here in Rhode island.

“I worked grueling 84 hour weeks, 7 days a week, 12 hours a day on the night shift, from 7pm to 7am,” said Pedro Us in a written statement, “For all that work, and on the night shift, I was paid only $360 a week, way below minimum wage and with no overtime.”

Gourmet Heaven 021Pedro Guarcas worked, at both the downtown and Meeting St locations of Gourmet Heaven. Guarcas claims that while on the job, he suffered workplace injuries and physical abuse.

“The managers pressured us to work so fast that I slipped and fell down the stairs twice and hurt my foot badly. This past April, the kitchen supervisor… punched me in the stomach when I was taking out the trash, but when I reported it to the store manager, he didn’t do anything about it.”

Guarcas claims that he worked 72 hour weeks for less than $400 a week, a paltry $5.50 an hour and well under Rhode Island’s minimum wage. Guarcas did not file any complaints because he has “a family to feed and it is hard to find another job.” Now that he no longer works for Gourmet Heaven he is speaking up in the hope of collecting his lost wages and because he wants justice.

Guarcas and another former Gourmet Heaven worker from Rhode Island, as well as a former worker from Connecticut, spoke at the protest. In addition George Nee, president of the RI AFL-CIO, James Riley, Secretary-Treasurer of UFCW Local 328, Providence City Councillor Carmen Castillo and union organizer Marino Cruz, recently dismissed from his job at the Providence Renaissance Hotel for his unionization efforts also spoke briefly to the protesters.

Some Wage Theft Doesn’t Get Prosecuted In RI

Even when wage theft is reported in Rhode Island, it isn’t always prosecuted, says Patrick Pierce who lost $1,000 when he didn’t get paid construction for a job he found on Craigslist

His employer, he told Dave Fisher last night at the State House, had already been extradited from Florida to Rhode Island on similar accusations of wage theft. (Maybe instead of being so worried about Rhode Islanders moving to Florida we should be concerned with the Floridians who are coming to Rhode Island)

But here’s the real kicker. Rhode Island doesn’t seem to care about the crime. Even after doing his own research and trying to use the system to recover his confiscated wages, he was told in a letter that the state won’t prosecute.

According to Amy Kempe, spokeswoman for Attorney General Peter Kilmartin, investigations of wage theft begin with the Department of Labor and Training. It is unclear if the AG’s office has a policy of not investigating wage fraud for less than $1,500, as Pierce says in the video. This post will be updated when we know more.

Fuerza Laboral, a grassroots labor organizing group in Central Falls, is pushing for more awareness of wage theft crimes. Pierce was at a State House press conference yesterday.

I’ve been the victim of wage theft at least twice in my career.

In the winter of 2001, I was flat broke hitch-hiking through Big Sur when I picked up some day labor with a local carpenter. After a long hard day of lugging plywood up a ladder and swinging a hammer on a rooftop high above the Pacific Ocean, the contractor paid me some – but not all – of what we had agreed to. The balance he was supposed to give me the next day, and I never saw him again.

Then, in 2005, I was working for a newspaper in Oregon when my editor asked us reporters to “manage” our weekly schedules in a way that equals about 40 hours a week, but to fill out our time cards as if we worked 8-hour days (even though as a practical matter we all worked more than 8 hours a day, everyday!).

If you’re reading this post, chances are you have never even considered not getting paid for your work. But chances are your boss has asked you to work for free, or to violate labor laws. Both are wage theft.

And both varieties go extremely unreported. The kind my editor did never gets reported because we’ve all been trained to believe that the way to advance a career is to let powerful people take advantage of you. The other kind – where, for example, the guy who cuts your grass will simply not get paid because he is an undocumented worker and his boss knows he has little recourse – that rarely gets reported either.

But according to Fuerza Laboral, a grassroots group that organizes and advocates for exploited workers, almost $3 million in stolen wages has been reported in Rhode Island since 2002.

Wage theft is a rampant problem amongst working people in Rhode Island. According to the DLT, $2,967,230 was stolen from working people in RI between 2002 and 2011. Immigrant and homeless workers are particularly at risk for having their labor exploited in this way.

Since many cases go unreported, the amount of wages stolen reported by the Rhode Island DLT is much lower than what is actually experienced by the working people of Rhode Island.

Just between the 32 participants in a study done by Fuerza Laboral, they reported at least $170,500 owed to them in unpaid wages, accumulated over the past 5 years.

Fuerza Laboral is holding a press event at the State House today at 3:30 to unveil its new report on wage theft in Rhode Island called, “Shortchanged: A Study of unpaid wages in Rhode Island.”

Note: The people who tend to get their wages stolen in this way don’t tend to vote, so politicians don’t tend to care about this issue.
