Darth Flanders Sets Sights on CF Mayoral Office

It turns out there’s at least one more job Central Falls receiver Bob “Lord of the Pink Slip” Flanders would like to eliminate from the financially struggling city: mayor. As if temporarily eliminating democracy from Central Falls wasn’t enough, now he wants to permanently eliminate democratically elected mayors and replace the position with an appointed city manager.

Flanders told the ProJo he would like to create a local charter review commission to look into the merits of switching from a mayoral form of government, in which the highest position in government is elected, to a city manager form, in which the highest position is appointed.

The article says “state and local officials are exploring the possibility,” but the only local official cited is Albert Romanowicz, who was appointed by Flanders to run the local jail. All the other local officials in the article – such as the mayor, not surprisingly – are against it.

Forget, for a moment, that mayors are less expensive than managers – in Rhode Island, the average municipal manager makes $101,480 a year and the average mayor makes $84,800 (meanwhile, average receiver makes in excess of $360,000 a year).

The really troubling issue here is that Darth Flanders is again going too far in his role as receiver.

Flanders has already over-stepped his bounds when he tried to institute an overnight parking ban in Central Falls. Sure, this would have made money, but that’s because he would have made it a violation to park where residents park in Central Falls, on the road. Few, if any, in Central Falls have three car garages, like Flanders does at his house in East Greenwich. While he pushed the idea through over the objection of the residents, Gov. Chafee had him rescind the idea the next day.

Similarly, the governor should tell Flanders to back off on his vision of permanently restructuring of the government by eliminating elected officials.

Central Falls does not suffer from too many elected officials, it suffers from poverty. There isn’t a high enough tax base to pay for the services that are needed. To that end, the receiver is well within the parameters of his responsibilities to shrink the size of government – though a better solution would be to work on expanding the tax base.

Either way, someone charged with financial oversight shouldn’t take action toward eliminating elected positions. It’s just unseemly, and it smacks of punishing the people of Central Falls for being too poor to pay for their services.

According to the Projo, “Flanders and his staff insist that the mayoral form of government invites patronage and cronyism.” But I’m not sure the same can’t be said of an appointed manager. At least mayors can be voted out of office. In fact, the very underlying principle of a democracy is that elected officials are held accountable by the people.

Evidently, Flanders doesn’t think this is working so well in Central Falls. “Let’s put it this way,” he told the Projo. The mayoral form of government “hasn’t served the populace very well to date.’’

If this is the case, Flanders could use the power of his position to create a community dialogue about these issues, or start a training academy for young local leaders.  Both of these ideas would better eliminate cronyism from government than simply trading a mayor for a manager, as well as have many other positive effects on the city.

But it seems as if Flanders is so hyper-focused on being the Lord of the Pink Slip that he forgot he actually has a once-in-a-lifetime opportunity to do something much bigger and more meaningful than just eliminate positions and divvy out haircuts.

Providence: My Favorite Town

There’s a show tonight at Machines with Magnets that I won’t be going to, but it will be King Hell awesome. I think The Silks are one of the best acts on wheels right now, even though I’m not really a roots music kind of guy.

Based on the advice of my friend Lord Giovanni, we brought The Silks up to the shop to cap off one of those morale-boosting days, and they positively CRUSHED it. It’s not easy to please true-to-life factory types, ultra-genius engineers and, well, me. But they had 100% of the people smiling. The support card tonight includes The Atlantic Thrills, who will rip your face off and gave up a stellar performance at last year’s Wooly Fair.

The wider music scene in PVD also includes The Rice Cakes clever post-pop, The ‘mericans ‘mericana as well as RI Future’s own Alex Moore’s The Invisible Hours psychedelic pop and Reza Clifton‘s soulful hip-hop to name but a few.

Okay, enough with the name-dropping link bait. You get the point.

Next month will mark my 20th anniversary as a Providencean (with a few years as a Bucketeer), and right now is the best it’s been. I realize that RI features some particularly ugly statistics and that some, even many folks are having a tough time. But for me, this is the most satisfying life experience to date.

Why? It’s the cult-chuh!

Compared to What?

Here’s the thing. It’s not like I moved here from South Carolina or the ‘burbs of VA. I’ve lived in Boulder, CO; San Francisco; Burlington, VT and East Jeezum, VT.

There’s obviously a pattern. I’ve always actively sought a liberal or progressive political culture and an active local arts scene. While I didn’t choose to move to Providence, I choose to stay because I really love it here.

It’s fashionable to bash on Rhode Island, and even I was pushed over the edge by my DMV-ing last week. But these negatives quickly fade away when I have so many stimulating and satisfying options from which to choose. When I hear people beef about RI, I really don’t get it. What do you want out of life, people?

Of course, Providence isn’t for everybody, and to each his or her own. I know that one frequent commenter is quite satisfied with the VA ‘burbs, although another person I know is positively hating it down there and can’t wait to come back. I’ve had family reasons to go to South Carolina many times, but I’m hoping I never have to go there again as long as I live.

To each his or her own. Fair enough.

Three One-of-a-Kind Examples of Awesome

If you’ve never been to a show at Machines with Magnets, you have missed a fabulous and unique experience. (GO TONIGHT!) MwM in Pawtucket is a recording studio, an art gallery and a performance space. And all the parts are strong. They’ve recorded both Battles records, local heros Deer Tick and a lot of other highly demanding artists. To call the shows in the gallery/performance space “intimate” does not express the immediacy of the experience. It is at once world-class, entirely approachable and actively supportive of the local scene. Where else can you cite that’s like that?

Wooly Fair, of which I am a part, is head and shoulders above any arts event I’ve ever been to. What makes Wooly so amazing is the complete and utter lack of support from anybody who’s not an artist or creative of some sort. There’s practically no corporate or civic sponsorship, and to date, it’s been almost entirely volunteer-driven. That leaves us free to create what no highly sponsored event can – total madness.

Lastly, Thee Red Fez is my favorite restaurant anywhere. Well, Bazaar in Amsterdam gives it a run for its money. It may be the ultimate expression of Providence-ness. Founded by a (married) couple of punks, it makes eclectic seem boring. The vibe is young and lively, and the menu is constantly changing with a focus on local ingredients. Chef Ed Raposa is a food genius. Breaded, deep-fried kim chee. Quod erat demonstrum. I’ve taken numerous clients there, and one – a true world traveler – paid it the ultimate compliment of photographing the menu and sending it to a friend as part of their ongoing best-menus game called “Where Am I?” None of the three guesses was “Providence”, and the revealed answer was met with complete incredulity.

This posting of some dozen-odd examples only scratches the surface of the outrageously rich cultural life that makes Providence such a great place to live. In conclusion, I like it here.

Speaker Fox Says Tax Equity Bill DOA

Despite nearly half of the House signing onto a bill that would raise taxes on the richest Rhode Islanders, Speaker Gordon Fox said he intends to keep his promise not to touch the income tax structure in this budget cycle.

“At this point I’m closing the door on doing anything with income tax until we have a little more historical evidence about what’s going with the reforms we did a few years ago,” he said.

In 2010, the General Assembly passed a budget proposal put forward by then Governor Don Carcieri to lower the tax rate on those who make more than $100,000 from 9.9 to 5.9. Fox said this will be the first budget year that the General Assembly can see how those tax cuts affect the state’s budget (people are now filing taxes for 2011, the first year the restructured rate was in place). He also said a number of tax exemptions were eliminated when the overall rate was reduced.

“When given all the information I think that a significant number members will support my position on this,” Fox said.

But some legislators, speaking on background, said the bill that would roll back the Carcieri tax cuts for those who make more than $250,000 a year, still has life – though it could look much different if it does pass.

Even Fox, who has described himself as a fiscally conservative Democrat, would not rule out taking another look at the tax code in future budget cycles.

“As we get the empirical data going forward what we’ll do,” he said, “I never want to make any predictions about what we would do in the future, but we’ll see.”

Racial Profiling, Vehicle Checkpoints Bills Heard Today

Last week here on RI Future, I shared a short podcast about Racial Profiling in RI from the perspective of youth and community organizers working with Providence Youth Student Movement.  Here is an extended series of excerpts from my conversation on Sonic Watermelons with Sangress Xiong and Yonara Alvarado, and Franny Choi.

Xiong, Alvarado, and Choi are among community members, law enforcement officials and members of the legislature who will gather today at the State House for a meeting of the House Committee on Judiciary; the Comprehensive Racial Profiling Prevention Act of 2012  (H-7256) is one of the bills to be discussed.

All of tonight’s agenda items deal with “Motor and Other Vehicles,” and most are about motorists driving under the influence.  A couple other bills that might be of interest to RI Future readers include H-7222, which “would authorize a bail commissioner to order that a person’s license be suspended immediately upon the report of a law enforcement officer that the person has refused a chemical test for driving while under the influence of alcohol” and H-7203 which, if passed, would “bar checkpoints as a means to detect motorists under the influence.”

Could Rhode Island Build a State-Owned Bank?

A state-owned bank. Essentially, a Bank of Rhode Island. This is the proposal floated by ecoRI News’ Kyle Hence in a January article about how the state sends its revenues out of state, where they go to improve the economies of other regions in the country, and indeed, the world. All this despite the fact that the state claims to be placing them in “local banks.”

The local banks? Citizens Bank, BankRI, Bank of America, Sovereign Bank, Washington Trust, and Webster Bank. The intriguing idea is that by creating a state-owned bank, Rhode Island would amplify its spending power (since banks have a special ability to loan out nine dollars for every dollar placed in their coffers) while creating an institution that could assist with handing out loans where the standard corporate bank is unable or unwilling to enter the market.

The greatest national proponent of the idea is Ellen Brown, a former Los Angeles civil litigation attorney, natural medicine advocate, and author of Web of Debt (her website is available here). Ms. Brown has written vociferously about the issue, advocating for a model based off the only state-owned bank in the United States, the Bank of North Dakota (Puerto Rico also owns its own bank, the Government Development Bank, created by New Dealer Rexford Tugwell). North Dakota has almost entirely avoided the economic recession, and is running a surplus.

The Bank of North Dakota (BND) is an anomaly in the U.S. financial system. Formed by the Nonpartisan League, a socialist-started faction of the Republican Party (yes, you read that right), its goal was to assist farmers in getting loans. Assisted by a state run mill (North Dakota Mill and Elevator, still in existence as the nation’s largest flour mill) as well as a prohibition against corporate ownership of farmland, North Dakotans have functioned with the BND for years. Its former governor and sitting U.S. Senator (Republican John Hoeven) is a former BND president.

BND essentially acts as the state’s coffers, instead of various national or multinational banks. As a result, it is not covered by the Federal Deposit Insurance Corporation (FDIC), because FDIC only insures up to $250,000, and the State of North Dakota deposits far more. This lack of FDIC coverage also means BND is outside of the regulatory burdens of the system. Because it didn’t do any subprime lending, BND was shielded from the subprime collapse. It also avoided credit default swaps and derivatives and all of the other various market instruments that we’ve heard so much about since the collapse.

This works largely because the bank is run by conservative bankers, who, according to their president, Eric Hardmeyer, follow “a Warren Buffett mentality–if we don’t understand it, we’re not going to jump into it.” The bank is also a partner to large banks, working instead to amplify the strength of credit unions.

Ms. Brown’s ideas of taking the North Dakota model have been an appealing idea in Great Recession America, especially as states faced high unemployment and reluctant lenders, problems still found in Rhode Island. Discussion of the idea seems to be largely cyclical, happening around this time each year. Multiple states have had legislation come up about it; and the Democratic candidate for Governor of Michigan made it part of his campaign in 2010. Small business owners and farmers in Oregon have banded together for the idea.

But there’s a hitch. A study for the state of Massachusetts by the Boston Federal Reserve found that the situation of the BND just isn’t replicable in most states, nor does it do what most advocates say it does. North Dakota’s economic situation is largely due to its energy sector (based on oil) and agricultural sector. Traditionally, North Dakota has a lower unemployment rate than the nation at all times. Furthermore, South Dakota does too, and lacks any such bank; South Dakota’s economic situation is comparable to North Dakota’s. Even worse, North Dakota has an extremely volatile economy, since it is largely based on agricultural prices, causing average income to leap across the charts.

But BND never steps in to stabilize the state’s economy (again, it is a conservative institution). Furthermore, while BND is a non-competitor to other banks in North Dakota, this is largely due to the fact that it mostly handles the state accounts and buys loans issues by local credit unions. Since North Dakota has one of the largest proportions of credit unions in its banking industry (a reflection on the state’s rural nature), it is thus a great boon to the state’s economy. But highly urbanized and dense states like Rhode Island have less than 10% of our banks as credit unions. Thus, a Bank of Rhode Island would most likely be a direct competitor to banks in Rhode Island, and possibly cause a banking crisis with its creation as it pulled state deposits out of the other banks.

The issue is largely that the conditions of North Dakota cannot be replicated in Rhode Island. BND President Hardmeyer stresses that the bank is run by bankers, not economic development people. He also is very timid about suggesting for other states, since BND is aimed specifically at issues that North Dakota faces.

Indeed, the creation of a BRI would have to follow along similar lines as the formation of a currently unpopular financial institution, the Federal Reserve. U.S. Senator Nelson Aldrich, a Republican Senator who served Rhode Island from 1881 to 1911, had long been an opponent of a national bank before he toured those of Europe.* Convinced of its importance, he returned to the U.S. and designed what became the Federal Reserve with much input from the nation’s bankers.

A BRI would have to not be in competition with private banks, and wresting the state deposits from private hands would be the most important hurdle to overcome. Any partnership involved in creating it would have to involve bankers, economic priorities and niches where the existing banks aren’t reaching would have to be identified, and an understanding of the goals of such a bank would also need be reached.

The state certainly should step in to do what private business can’t accomplish. But improperly executed, a Bank of Rhode Island would be a disaster and discredit state intervention. As an issue, its importance is in highlighting where our economy isn’t functioning properly, a conversation necessary during these times.

Advocating to End Racial Profiling in RI

PROVIDENCE, RI – On Wednesday, March 7 at 4:30 PM, community members and advocates are expected to show up en masse to share their views on racial profiling in RI at a hearing at the State House before the House Committee on Judiciary.  But folks have been speaking out on the topic for years, including youth and adult advocates from Providence Youth Student Movement (PrYSM), an organization founded to support Southeast Asian Youth in Providence.

Hear more about their work here in this podcast of excerpts from my February 15 interview with PrYSM youth leaders, ?Sangress Xiong and Yonara Alvarado, and PrYSM staffer Franny Choi.  It aired lived on my weekly program, Sonic Watermelons on Brown Student and Community Radio.

During the interview, Xiong, Alvarado and Choi talk about recent campaign actions, like the February press conference introducing House Bill 7256, the making of the local documentary called Fitting the Description, and other recent activities that they have participated in with PrYSM and the Coalition Against Racial Profiling.  Alvarado (who is Latina) says she became passionate about the topic after being in the car and witnessing racial profiling when her uncle was stopped by an officer, and subsequently feeling less faith in whether officers are best serving the community; Xiong, who is Hmong (Southeast Asian), helps explain how a practice once known as “Driving while Black” has expanded to include not only the Latino/Hispanic community, but the Southeast Asian community in Providence as well – including friends and neighbors of his.

I also spoke with the three guests about the benefits and limitations of using digital media tools to collect stories from people who’ve been subjected to racial profiling, and for doing outreach about legislative efforts like the Comprehensive Racial Profiling Prevention Act that will be reviewed and discussed at next Wednesday’s House Judiciary hearing.  The ten-page bill deals primarily with conduct during motor vehicle stops and searches, and among the provisions are:

  • Requirements for officers to document (in writing) the “reasonable suspicion” or “probable cause” grounds for conducting a search of any motor vehicle,
  • A determination that identification requested during traffic stops be limited to driver’s license, motor vehicle registration, and/or proof of insurance, and (unless there is probable cause of criminal activity) only asked of drivers
  • A mandate to create standard policies and protocols for police vehicles using recording equipment, such as documenting every stop that is made and prohibiting the tampering or disengagement of equipment.

In addition to collecting the probable cause information, the bill would require officers to collect data on race during stops – and departments to maintain and report this data at intervals over a 4 year period.  Choi says collecting data is key to ending racially divisive practices, and – along with the ACLU in their work on the topic – points to a local, southern RI city for proof of its inclusion in the bill as being “effective legislation.”

In Narragansett, says Choi in the excerpts, the department began collecting information without the legislation, and found a drop in “racial disparities in stops” after instituting the policy.  The ACLU also found recent actions and improvements in Johnston.  At the end of the day, says Choi, “when you’re pulling someone over, have a reason to pull them over.”

Care providers feel sting of state cuts to disabled

Employees of the Seven Hills developmentally disabled care facilities in Rhode Island are striking today to call attention to what their union representative says is an unfair attempt by management to cut their pay. The proposed pay cuts, he said, are a direct result of losing $26 million in state funding in the current year budget.

“While we think what the employer is doing is wrong,” Jack Callici said, “The governor has completely turned his back on the developmentally disabled by not restoring one penny that was cut last year.”

He said the 250 union members he represents at the 17 Seven Hills facilities in Rhode Island and southeast Mass. have been asked to accept a 5 percent pay cut as well as a 10 percent increase health insurance costs.

“These are $10 an hour workers,” Callici said. “They can’t afford this. They will either reduce their coverage down, or drop it altogether.”

He said the budget cuts would be more easily absorbed by Seven Hills employees who have much higher pay grades. Noting that the union pay cuts would save about $100,000 and CEO David Jordan earned more than $500,000 in 2009, Callici said, “if that poor guy brought in just $400,000, it would pay for all the cuts.”

Seven Hills isn’t the only facility for the developmentally disabled in Rhode Island reeling from state budget cuts. Many facilities, according to Callici, have cut service to people with developmental disabilities from eight hours a day to six.

“Eight hours is important so people can go to work,” he said.

Rhode Island Federation of Teachers and Health Care Workers union rep Jim Parisi said the Trudeau Center in Warwick has also cut service from eight to six hours. He said employees he represents there could have their hours reduced to part-time, which would “will cost them thousands if they have medical insurance.”

Bill would raise minimum wage in Rhode Island

You’ll often hear the mantra that Rhode Island has one of the highest tax rates in New England. Well, on the other side of economic spectrum, we also have the second lowest minimum wage in New England.

But Rep. David Bennett, D-Warwick, sponsored a bill that would raise Rhode Island’s minimum wage from $7.40 to $7.75. It will be heard by the House Labor Committee tonight after the regular session.

“You try living on that,” Bennett said. “You can’t do it.”

While the increase would only mean another $14 a week for employees making the minimum wage, annually that is enough to make a mortgage or rent payment. Or at least pay some utility bills.

Still, the increase would only put Rhode Island at the second lowest rate in New England. Currently, only New Hampshire has a lower minimum wage at $7.25 and the proposed increase would vault RI ahead of Maine, which has a minimum wage of $7.50. Vermont has the highest minimum wage in New England at $8.46.

“If someone can make an extra dollar an hour by taking a similar job in Vermont,” Bennett said, “they might just do that.”

Nationally, Rhode Island falls right in the middle of the pack with the 26th lowest minimum wage in the country. Most of the state that have a lower minimum wage are in the midwest, where the cost of living is much lower than on the coasts. New Jersey and Maryland both have a minimum wage of $7.25, which is the lowest it can be according to federal law.

If the bill becomes law, Rhode Island’s minimum wage would increase annually starting in 2014 in conjunction with the Northeast Consumer Price Index.

PROVIDENCE, RI – Are Rhode Islanders paying fees for loans that are higher than what residents in other states are paying? The answer in some cases is yes – 260% versus 36%. Marriage equality back on State House agenda

Same sex couples in Rhode Islanders will have another opportunity at equal protection under the law as Rep. Art Handy, D-Cranston, will again introduce a bill in the General Assembly that would afford the same marriage rights as their heterosexual counterparts enjoy.

“Every year we move forward,” Handy said, who has introduced a similar bill in the previous nine legislative sessions. Sen. Rhoda Perry, D-Prov., will introduce the bill in the Senate.

Last year, Rhode Island passed a law that allowed gay couples to enter into civil unions. But civil unions, especially Rhode Island’s version, is not tantamount to marriage.

“Separating straight and gay couples into different institutions just isn’t legal,” said Ray Sullivan, of Marriage Equality Rhode Island. “Until same sex couples can marry, Rhode Island has not achieved justice under the law.”

Aside from the fact that “separate but equal” has already been deemed unconstitutional, Rhode Island’s civil union law has a provision that allows religious institutions, such as Catholic hospitals, to be exempt from some of the law’s provisions, meaning a Catholic hospital could deny a family member access to their spouse during an emergency situation or a religious school could deny health care benefits to an employee’s same sex spouse.

There is another bill that will be introduced that would repeal this part of the state’s civil union law, known as the Corvese amendment because Rep. Doc Corvese, D-Prov. and an ardent opponent of gay rights, managed to sneak the provision into the bill at the eleventh hour last session.

Because of the Corvese Amendment, Sullivan said. “Rhode Island has far and away the most discriminatory language of any marriage or civil union bill in the country.”

Last session, the same sex marriage bill did not get a straight up or down vote, even with the speaker of the House, Gordon Fox, being openly gay. He told me after last session that not supporting gay marriage was one of the most difficult decisions of his political career.

Senate President Teresa Paiva Weed does not support equal marriage rights for same sex couples. She told me last year that she thinks Rhode Islanders are more comfortable with civil unions than gay marriage. A poll last year indicated that Rhode Island actually supports gay marriage 50 percent  to 41 percent.

Some legislators have said they worry about electoral repercussions from Catholics, but in Massachusetts “every legislator who supported marriage equality and ran for reelection was reelected,” according to Sullivan.

Despite headline, RI actually has moderate sales tax rates

If you only read the headline from the Projo today you’d think Rhode Island has again, as the common talking point goes, landed on the losing end of a list of worst states as far as taxes go.

“RI tax burden still among highest in U.S.,” reads the headline.

However, if you took the time to read even the first sentence you’d learn that, actually, the Ocean State is somewhere in the middle of the pack nationwide as far as sales tax rates people pay state to state.

“Yet another ranking of the states’ tax burdens puts Rhode Island at the bottom in New England and in the middle of the U.S.,” reports John Kostrzewa.

The study, by The Tax Foundation, actually ranked Rhode Island 20th in terms of effective sales tax rates that a person would pay in a given state.

While Rhode Island’s state sales tax rate is tied for the second highest in the nation, when local sales taxes are factored in we drop down considerably. It’s an important distinction because it matters little what one jurisdiction or another may charge for a sales tax compared to what the consumer pays in actual retail sales taxes. There are 36 states that have local sales taxes and RI is not one of them.

“A state with a moderate state sales tax rate could actually have a very high combined state-local rate compared to other states,” according to The Tax Foundation’s report.

Kostrzewa makes an interesting point in his article that could actually, if The Tax Foundation factored it in, drop Rhode Island even lower on the list of states with high sales tax burdens.

“There is no mention in the report that Rhode Island’s 7 percent tax is not charged on all items,” he reports, “or that Governor Chafee has proposed that the sales tax be extended to taxicab and limousine rides, car washes, pet grooming and shoes and clothing that costs more than $175 an item. Or that the 8 percent meals and beverage tax be hiked by 2 percent under Chafee’s plan.”

The first clause of his sentence proves Rhode Island’s sales tax burden is actually lower than it may appear in the study (although this may be the case in other states, as well). The second part absolutely doesn’t belong in the study because it is not a part of Rhode Island’s tax system and it’s entirely likely these potential new sales taxes will never become reality. Somewhat similar ideas were cut from the proposed budget last year.

It’s important that Rhode Island discuss its taxing obligations in an honest and fair way, and as a community we aren’t always great at that. We’ve all heard the talking point that people routinely relocate away from Rhode Island because of high taxes and low marks in tax surveys.

On the other hand, just today, as it happens, the Providence Journal also ran a letter from the tax-hating former conservative senate candidate Bob Tingle on why perhaps we shouldn’t worry about those who threaten to flee the state for fiscal reasons. Tingle moved to Florida about a year ago but then decided to move back.

“Rhode Island has its faults, as does everywhere else,” he wrote about his homecoming. “But, Rhode Island is a beautiful and wonderful place. I am proud to be a Rhode Islander and I am extremely happy and grateful that my children grew up here. God Bless our beautiful Ocean State.”

Why Getting Tough Is Weak

This week the Senate Judiciary voted to eliminate Good Time for people convicted of murder or serious sex offenses (1st degree child molestation, 2nd degree child molestation, kidnapping of a minor, and 1st degree sexual assault).  (Good Time is the 10 days per month a prisoner receives for good conduct.  In a month where the prisoner gets in trouble, they get no Good TIme, and will get 1-3 months worth of Good Time subtracted from their total.)  At the same time, as blogged by Tom Sgouros, A.G. Kilmartin let Wall Street off the hook on the foreclosure crisis.  The Attorney General also has a “White Collar Crime” proposed bill that isn’t about white collar crime- it is about corrupt public officials exclusively.  He has absolutely no response to the financial crisis that is rampant with actual criminal activity.

It has long been accepted that White Collar crime is more serious than street crime.  Even the political debates, which focus on fear and leave rationality behind, don’t have space to waste on street crime- but the Bailout, foreclosure crimes, and mass healthcare fraud make the cut.  Yet when it comes to taking action and making the world a safe and secure place, we come back to the tried-and-true.

The “Woodmansee” legislation will put more pressure on the parole board to either release someone, or serve a long and costly incarceration.  As prisoners age they get more expensive.  Rhode Island will find out.  Still unwilling to do something as little as make marijuana possession a civil penalty, the General Assembly’s thirst for prisoners may never cease.  Even as the state crumbles around them.  It is understandable to want to kill those who have committed terrible crimes, or in lieu of that, lock them up forever.  Two factors need to be factored into that impulse: money and morality.

Plea bargains do as much, if not more, for the taxpayers than they do for the accused.  It is no small thing to plead guilty to a serious offense, to give up any slim hope of exoneration, or being convicted of a lesser charge.  Pleading guilty means admitting to the facts laid out by the Attorney General, and these are not agreed upon in the bargain.  They may be inaccurate, and they may come back to haunt someone who is looking for work years later.  Pleading guilty also means saving the taxpayers the cost of a trial.  Lawyers on both sides should be spending dozens of hours in preparation for a trial.  Their investigators would be spending days in preparation.  Expert witnesses would be found, and paid.  Although the Attorney General’s office and Public Defender are salaried, rather than hourly, enough trials would bring the entire system to a halt.  More staff would be hired at a few more million per year.  And to avoid this, the Attorney General offers a seemingly lighter sentence than would be had from a judge angry at the audacity of taking it to trial.

Judging by the Attorney General’s attitude towards prisoners, that they all should serve as long a sentence as legally possible (and in some cases, such as Woodmansee’s, spitting in the law’s face)… it is impossible to see any space for rehabilitation in the Attorney General worldview.  This is not particular to him.  A.G. Lynch, and most A.G.’s around the country, also have lobbyists who fight against any relaxation in the street crime laws, and also actively pursue increases in these laws.  Thus, they should not be taken seriously when engaging in, or talking about, reentry or rehabilitation.

Eliminating Good Time based on someone’s crime reinforces the notion that someone will always be the sum of a single day.  That they can not change.  That they are their crime.  This analysis is rampant throughout the criminal justice system, and is not very useful in assessing rehabilitative needs.  As someone who has been out for nearly seven years from a second degree murder conviction, I would still be on parole if not for Good Time.  And that is assuming the parole board would have looked as favorably on my situation, if my release date were September, 2013.

I’ve been asked recently if the Woodmansee Law, which will surely go through (yet not affect Michael Woodmansee, of course) will be applied retroactively.  It is not uncommon for states to feel that court decisions, including those ruled by the U.S. Supreme Court, do not bind them.  So it is possible that RI will apply this rule to several hundred prisoners at the ACI. It will not hold up in court however, as prisoners have a “liberty interest” in Good Time credits; once given, they cannot be arbitrarily revoked.

Rhode Island has not hit rock bottom on “Getting Tough” on street crime.  It may take more budget, more staff, more prisons.  There is some debate of whether anything political can change course without a cataclysmic event.  Whereas a minority of the General Assembly do bring some wisdom to the table rather than a “base mobilizing” approach to extremist positions, we shall see.

Hard Talk About an Ugly Economy

Job Sector Contribution to the RI EconomyAfter several months of more-or-less positive jobs numbers in RI, the last two months have been anything but. And the December numbers were, frankly, horrific. While it is certainly true that a wonk could parse [spin] the recent down-turn toward neutral, the same could be done with the previous up-cycle.

As the wonk that could do either, let me tell you this: the jobs scene in RI is bad. Damn bad. Later, I’ll parse these numbers to show how bad things really are.

Unlike my usual polemics, I’m not going to rant as if there were some obvious course of action on which pols are unwilling to act [even though that’s been true for decades]. At this point, I don’t have a lot of answers, just one brutal, ugly question: where do we go from here?

So, enough with the introductory niceties; let’s have at.

RI’s Jobs Numbers Since the Economic Collapse

Before we can talk about our numbers since the collapse, we need to appreciate that the mid-00’s were the best economic times RI had seen in decades. Of the main jobs indicators, all of them – labor force, employment and unemployment – topped out in 2006/2007. Being the Biggest Little, we need to accept that we largely rise and fall on the national trend. Or at least, we rise on it.

Ed/Health has held its gains since the collapse while professional services and hospitality, which showed solid gains to 2008, have only modest declines since. Construction, not surprisingly, along with government employment, financial services and trades, transportation and utilities (TTU) have sloped off badly.

It’s important to note that I haven’t parsed the contribution of construction in RI relative to other states, but given the collapse of manufacturing, it is at best a secondary impediment.

Long story short: our problems today are the same as our problems 20 years ago – manufacturing is dying, and we have not yet found a way to replace those jobs.

The Recent Horrors

For most of this year, we followed or even amplified the national trend downward until October, when we hit some kind of top and turned counter-trend. In the fourth quarter of 2011, we diverged almost a full percentage point from the national average.

That, my friends, is some ugly shit.

Granted, I could spin these declines toward neutral, but just as easily could I spin the gains toward neutral. The gains were mostly declines in the labor force – that is, people who say they’re looking for jobs – while the declines were gains in the same.

Long story short: we’re not creating jobs, we’re treading water. People dropped out and then dropped in again.

I probably should have mentioned that we need to create 40,000 jobs to get back to “full employment”. 40,000 jobs on a basis of just over 500,000 employed means 1 new job for every 12.5 that currently exist. It’s a giant number.

But wait…it gets worse.

The Current Situation

Look at this jobs board. Plenty jobs listed, for a certain kind of worker. These are all full-time jobs, and they are recent listings. Even ones from months ago may still be unfilled. This state lacks highly educated workers. In fact, we lack moderately educated workers – we import welders. Not Ruby on Rails developers – welders!

That’s the situation. RI’s historic under-investment in education has yielded a work force ill-prepared to face the current economy, much less the emerging one. [See above under collapse of manufacturing sector.]

To be sure, if you drive an automobile on an elevated highway, it’s important that welders that construct the steel-on-steel joints that support the reinforced concrete substrates that hold the gloriously smooth asphalt on which you drive understand the operational parameters of joint strength relative to weld length and depth as that applies to steel grade and thickness.

“Welder” does not equal “ignoramus”. If it did, you’d be dead. [If welder had ever equaled ignoramus, he or she would be dead. Welding is, you know, dangerous. Go pick up a torch some time…]

So we need a range of workers, and we import some of them from India or Slovakia or Colombia. Meanwhile, we export highly educated workers to such remote locations as Massachusetts.

But none of that does Jack Squat for our unemployment numbers. Why? Sadly, that answer is all too simple.

Our Prospects

Long ago on a blog far, far away, I wrote a post called “Our Prospects for Economic Growth”. And that post was just as cheery as this one. The cold, hard fact is that the RI’s unemployed are poorly suited to those scant jobs our economy is creating.

This state’s historic disinvestment in education has created a self-reinforcing feedback loop in which jobs exist for imports, and local don’t get jobs. I call this phenomenon “government at war with its population”. If you don’t have an advanced degree, they want you to go away…to some other place where people like you live. While the cities of Pawtucket and Woonsocket (and the ex-government of Central Falls) exemplify this trend, the RI state government proves it out, as well.

To the long-term denizens of the State House, “welder” – challenging as that job might be – is not good enough for them. They want you to have an advanced degree in micro-biology, computer science or (choir of angels) business management before they’ll say you’re RI material. [Note: Financial Services is among the employment sectors that collapsed, much to Smithfield’s chagrin regarding the enormously expensive and now only partially occupied Fidelity campus.]

Except this: RI has an unemployment rate of 10.8% as of this writing, and those people lack substantial education. What’s to do?

Non-Snarky, Future-Oriented Discussion

This state needs to recognize the fact that we’ve got a serious problem, and it’s not going to fix itself. It requires action – immediate, meaningful action. Here are some things I think we can look to create some jobs at the lower end of the wage/education scale.

Get our heads around the “1099 economy” – Having been self-employed for about a decade, I know that it doesn’t really matter if you have “a job” so long as you have “work”. But the deck is stacked badly against the 1099-ers. From health insurance to FICA, you pay a serious penalty when you try to strike out on your own. The Powers that Be have only recently become aware that there is such a thing as the 1099 economy, so they’re still getting up to speed on what it means and how they can help move it forward. Recent changes to the RI EDC Board of Directors certainly help, but they need to be far more aggressive about making this happen.

Fulfill our “Arts and Entertainment” Promise with a Downcity Casino – Like it or not, Providence is known as a party town, and we should build that out for all it’s worth. Despite all it’s challenges and downsides, I think it’s possible for us to “do a casino right” so that we get maximum benefits. And we should go the whole hog, including the postage. We should take a serious look at developing looser rules around the vice trades in which government oversight and monitoring keeps the criminal element at bay. In simple terms, we take a more Cuban or Dutch approach to the sex trades where pimps are replaced by health services.

Sell “War-on-Joblessness” Bonds that Fund Infrastructure – The same way the US sold War Bonds in the 2oth century, we sell bonds to fund the infrastructure critical to a thriving economy. Because we’re not auctioning bonds on the market but selling them directly, we can set the interest rate where ever we want it. The payoff for investors is more moral than financial. Crazy-talk, I know, but it could happen.

Take Another Look at “Dirty” Industries – The new metals recycling operation on Allens Ave is the kind of “working waterfront” thing we would do well to expand on. Garbage is big business, and it’s the kind of unglamorous industry that nobody goes after. Like the casino, it’s disastrous if done wrong, but brilliant if done right. I’m actually a connoisseur of dumps, so I’ve visited or read about some very advanced operations.

What else? My ideas aren’t the only possibilities. But whatever we talk about doing, it has to focus right down on the kind of jobs we need, not the kind of jobs we want.

Principles are Worth More than Political Awards

You may have heard about our recent letter to General Treasurer Gina Raimondo requesting that she return an award from The Manhattan Institute, an extremist right wing group that promotes offensive, ignorant and hurtful positions towards the LGBTQI community, women, minorities, and our environment.

Marriage Equality Rhode Island was among a group of organizations that respectfully asked Treasurer Raimondo to return the award and condemn the hateful positions promoted by the Manhattan Institute. Instead of returning the award, she defended her association with the New York think tank by saying: “Accepting an award from any organization is never an across-the-board endorsement of its leanings.”  But that just misses our point.

Organizations like the Manhattan Institute use awards programs for many purposes, including raising money and validating their positions on a range issues to a broader, mainstream audience.  A cursory review of the Manhattan Institute’s website will, in fact, lead one to a number of articles and position papers that advance an anti-gay agenda and misogynistic agenda.

As LGBTQ people we know the power in who you will or won’t stand next to you. We know that standing for equality and fairness means refusing to stand next to ignorance and hatred. Raimondo’s close association with this organization could be interpreted by many as implicit acceptance of all their positions, not just those related to public pensions. We have advised the treasurer that those who aspire to political leadership are judged by the company they keep. Principles are worth far more than political accolades.

Girl at the Center of the Cranston “Prayer Banner” Case targeted by Cyber-Bullies

Upfront let me say that I am proud to be an uncle to the amazing Jessica Ahlquist, the student who two days ago won her case against the City of Cranston over an unconstitutional “prayer banner” on display at her school. It was not only a victory for Jessica, but a victory for everyone in this country who values the Constitution, freedom of conscience, and our secular society. Founder Roger Williams based the government of Rhode Island on these principles, establishing the first secular government in history and the freest land in the world at the time.

From time to time, of course, we need reminding of our history and of the importance of our Constitutional rights, and Jessica did so with a grace and poise not often found in people well older than her.

That’s why it’s so difficult to talk about the threats and cyber-bullying that she has been exposed to since the verdict came down. One website provided a long list of screenshots of these, and they are truly deplorable.

“shes not human shes garbage”

“I think everyone should just fight this girl”

“I’ll drop anchor on her face”

“Let’s all jump that girl who did the banner”

“When I take over the world I’m going to do a holacaust to all the atheists”

“i cant wait to hear about you getting curb stomped”

“everyone is going to beat you up prob”

“what a little bitch lol I wanna snuff her”

This from people defending a Christian Prayer on the wall of a public school. A prayer that says, in part:

“Help us to be good sports and smile when we lose as well as when we win,”

That’s irony.

To the credit of the Cranston School Committee, when I contacted them with my concerns, they were quick to assure me that the Cranston Police have been investigating these threats since last night, and that they are taking this issue very seriously.

Cranston School Committee Chairperson Andrea Iannazzi admits being troubled by what she has seen but “will not break confidentiality by discussing students behavior or discipline…” Which is fine, because most of this bullying behavior and threats come from minors, and as long as appropriate action is taking place, all should be well. Also responding were Steve Bloom, Frank Lombardi, and committee member McFarland. Cranston Superintendent of Schools Nero is aware of the situation, as is Assistant Superintendent Judy Lundsten.

As a parent, an uncle, and a citizen of Rhode Island, I am glad that the situation is being addressed in a forthright and professional manner. Title 16-21, concerning the Health and Safety of Students, defines bullying as “the use by one or more students of a written, verbal or electronic expression or a physical act or gesture or any combination thereof directed at a student that… places the student in reasonable fear of harm to himself/herself…” or “creates an intimidating, threatening, hostile, or abusive educational environment for the student…”

As an atheist Jessica is part of a minority that is currently under attack at her school. If she were black, Jewish or gay there would be a huge outcry against her being treated in this manner. Given that our society is, at its best, concerned with the health and safety of all our children, I am pleased by the prompt action Cranston city officials seem to be taking.

Make Serious Investments to Create Good Paying Jobs for Rhode Islanders

Dear Mr. President:
Over recent weeks I have visited Main Street small businesses and toured manufacturing facilities throughout Rhode Island’s First Congressional District. I have met with jewelry makers, boat builders, and creators of cutting edge medical devices and aeronautical components, and heard from restaurant owners, small textile retailers, and information technology start-ups. Across this diverse array of interests I hear one common and constant concern – in order to survive, prosper, and grow, entrepreneurs and seasoned small business owners alike need consumers, and those consumers need jobs.

Since becoming a member of Congress, I have hosted Town Hall and Tele-town Hall Meetings in communities across my District in an effort to hear directly from constituents. With unemployment in my state and across the country at unacceptably high levels, we must heed concerns from Main Street and the families we serve. In light of recent Congressional Budget Office projections that forecast slow economic and job growth, and in advance of your announcement outlining recommendations to spur job creation, I would like to take this opportunity to share the views of constituents in Rhode Island’s First Congressional District and some of my thoughts on this critical matter.

Rhode Island was the first state in the northeast to enter the recession three years ago, and at 10.8%, our unemployment rate continues to be among the nation’s highest. As you have consistently expressed, our government must set priorities, cut what does not work or is not needed, and make the investments that will create jobs, sustain our economy today and into the future, and ensure our ability to compete in the world.

Nationally, the manufacturing sector has been a bright spot even during these trying economic times. If this vital economic engine is to be sustained, we must continue our investments in programs that help manufacturers compete in a global economy, retool to be more efficient and effective businesses, and retrain the workforce so that skill sets utilized in declining sectors can be transferred to those that are expanding. This is the driving force behind my Make It In America Block Grant legislation and a number of common sense, job- creating bills that have been introduced in the 112th Congress to strengthen and modernize our nation’s manufacturing industry. I strongly encourage your Administration to carefully consider these proposals that will help bolster research and development, expand advanced manufacturing capabilities, and level the playing field with our foreign competitors.

If we are going to strengthen our manufacturing capabilities and make new products here at home, then we must have the ability to execute the timely and effective transport of goods, people, and ideas. This work will require significant investments, both public and private, in our nation’s infrastructure. A critically important first step in this effort is the passage of a robust surface transportation reauthorization.

Building and repairing our nation’s highways, roads, and bridges now is not only a surefire job-creating strategy, this important infrastructure work also helps advance the broader economy, enhances the safety of our citizens, and is a far more cost-effective investment today than it will be in the years ahead. Without a doubt, we must work collectively to rein in our nation’s debt. However, numerous studies, such as the Infrastructure Report Card from the American Society of Civil Engineers, clearly demonstrate that we cannot be responsible stewards of our nation’s finances if we continue to allow the price-tag for infrastructure improvements to escalate with each passing year.

This vital work also extends beyond roads and bridges, and includes our nation’s water systems, ports, schools, public parks and facilities, power grids, and telecommunications. The nearly 14 million unemployed Americans, more than 61,000 of which reside in Rhode Island, demand bold action from their government. When our nation endured the economic strains of the Great Depression, it was bold action in the form of the Works Progress Administration, the Civilian Conservation Corps, and the Public Works Administration that helped put Americans back to work, building and repairing our nation’s infrastructure.

While labor and financial market conditions in the 1930s may have been vastly different than today, what remains the same is the underlying notion that a robust investment in rebuilding our nation’s roads, bridges, and schools will generate job growth and enhance our ability to compete in the global economy. Investing today in building and restoring our nation’s infrastructure is not only smart job-creating policy, it is also smart fiscal policy – as continued deferred maintenance drives the future costs of repairs higher and higher. I strongly urge that your recommendations for job creation include a range of options that encourages both public and private investment in this important work – including the creation of an infrastructure bank and enhanced, innovative, and effective funding opportunities for states, cities, and towns that will put people back to work on priority infrastructure projects.

At the same time, we must recognize that a comprehensive proposal to create and sustain jobs in America must include initiatives that support workforce training and small businesses. Job growth today and into the future, especially for our nation’s manufacturing and construction sectors, requires enhanced support for effective on-the-job training programs, and greater collaboration between our elementary and secondary schools, higher education institutions, and employers in developing multiple career pathways for young adults and improving the skills of unemployed and underemployed Americans. Furthermore, as a member of the Committee on Small Business, I strongly encourage your continued efforts to expand small business access to capital, the lifeblood of small start-ups and longstanding businesses alike. The more than 95,000 small businesses in Rhode Island make up 96% of the state’s employers. They have endured the brunt of our nation’s economic downturn, and our country’s full and sustained economic recovery requires that small businesses have access to the resources that will allow them to form, grow, and prosper.

As the debt ceiling debate underscored, there is strong disagreement about the best approaches and the appropriate role for government in creating jobs. There is no shortage of ideas on how to put people back to work and spur economic growth in the near-term. But, the time for bold action is now. On behalf of my constituents in Rhode Island’s First Congressional District, I thank you for this opportunity to give voice to the small businesses, manufacturers, builders, and unemployed as you prepare your proposals. I look forward to hearing your recommendations, and working to find common ground across the aisle and between levels of government to help put Americans back to work.
