2015-09-13 AIDS Walk RI 049Participants and observers of the AIDS Walk RI opening ceremonies were given a treat when Ronald Lewis, activist poet and actor, spoke about the forgotten transgender, women of color origins of the Stonewall Uprising, the birth of the LGBTQ liberation movement. Marsha P. Johnson and Sylvia Rivera are only recently being given the recognition they deserve by history, they are true heroines in the ongoing struggle for full rights for all persons, and to be reminded of their contributions ahead of an important walk to raise money to combat the scourge of HIV and AIDS was invigorating.

2015-09-13 AIDS Walk RI 008This year’s theme for AIDS Walk RI was “Keeping Hope Alive” and despite the reality of nearly 100 new cases of HIV being diagnosed in our state every year, there is hope that one day HIV will be eradicated. Dr. Philip Chan, MD, from the Miriam Hospital’s Immunology Center said that giving a positive HIV diagnosis to a patient is the worst part of his job. He talked about the virtues of a new drug, PrEP, a pre-exposure prophylaxis that prevents the transmission of HIV.

2015-09-13 AIDS Walk RI 052Dr. Nicole Alexander-Scott, MD, MPH spoke of three foci at the RI Department of Health, where she is the director. “We want to continue to enhance partner services, making sure that people know how to stop their partners from getting infected by raising awareness. getting tested and letting them know about PEP ad PREP. We also want to highlight our ‘men who have sex with men communities’ that are disproportionately affected by HIV and syphilis and some of the other STDs… our third priority is also highlighting our youth and our communities of color, where there are higher rates of STDs as well as HIV.”

2015-09-13 AIDS Walk RI 034Members of Hope Harris‘ family gathered on stage to present the “Hope Harris Award.” Harris was a member of the AIDS Project RI board for the last part of her life.  She was also a longtime receptionist for the late Senator John Chafee and also served in Senator Lincoln Chafee‘s office. She was known as a kind and deeply religious person who recognized the value of person, without regard to race, orientation or gender identity.

The award was presented to the amazing Paul Fitzgerald, president and CEO of AIDS Care Ocean State. He was the founding executive director of “Family AIDS Center for Treatment and Support” (FACTS) for children with HIV. FACTS was one of the first 13 pediatric AIDS demonstration projects in 1988. FACTS grew into a full-service AIDS organization, and merged with “Sunrise House” to become AIDS Care Ocean State.

Entertainment was provided by the Providence Gay Men’s Chorus, and other speakers included by Mayor Jorge Elorza, RI State Treasurer Seth Magaziner and US Representative David Cicilline. Cicilline lead the event in a moment of silence for Guy Abelson, well-known local philanthropist, who passed away recently and was deeply involved in the fight against HIV/AIDS.

I know of no journalist more deserving of accolades than my dear friend and colleague Steve Ahquist, who was honored by Rhode Island Pride last night for his impressive and extensive coverage of issues affecting the LGBT community.

monteiro ahlquistAt its annual gala, Rhode Island Pride will recognize Kate Monteiro, a gay rights activist, and Steve Ahlquist, a progressive journalist, for their contributions to the LGBT community. The event is Sunday, September 13, 6:30 at the Providence Marriott.

Monteiro, who has been on the front lines of the fight for gay rights in Rhode Island for decades, will be presented with the prestigious “Pyramid of Pride” award.

“Kate’s tireless advocacy for the state’s LGBT community dates back more than 30 years and while no one individual could ever be said to be the single leading light of the struggle for gay rights in Rhode Island, her name would unquestionably come up for consideration in any such discussion,” RI Pride said in a press release. “In 2015, the year that has seen nationwide legalization of gay marriage, it is only fitting that the Pyramid of Pride award should go to Kate Monteiro.”

Monteiro said of the honor,”It sounds like cliche to say I stand on the shoulders of giants. But the truth is I have been blessed to have been born and raised in this time and place – to be witness to such great changes, and to have worked shoulder to shoulder with so many great RI activists – a great number of the straight allies who took our cause as their own. You can’t ask for a better place to raise some hell than the Greatest Little State!”

Ahlquist, a journalist for RI Future and a well-respected community activist, is being honored with the “Spirit of Pride” award.

“Steve has tirelessly covered any and all LGBT events from marriage equality testimony in the Statehouse to rallies against hate  crimes and efforts to promote transgender health,” said RI Pride of Ahlquist. “His activism is by no means limited to the gay community as he also advocates workers’ rights, efforts against homelessness, and other social justice issues including those that affect women, racial minorities, and any other marginalized groups in the state.  Steve is primarily known as one of the founders of the Humanists of Rhode Island and was honored as their Humanist of the Year in 2014.  Rhode Island Pride takes great pleasure in following the Humanists and designating Steve Ahlquist as the recipient of the Spirit of Pride Award in 2015.”

Ahlquist said, “I am deeply honored and humbled to be recognized by RI PRIDE. I will treasure this award and let it remind me every day that there are countless people without voice seeking liberation and equality. I see it it as my duty, as a journalist, not to provide the voice, but to provide the microphone, the amplifier, through which these voices can be heard. I won’t stop.”

#TransLiberationTuesday demands end to violence against trans women of color

tumblr_ntlehjNAu41u3nkrio2_1280August 25th brings a nationwide direct action effort, building solidarity and organizing coalitions to end the rampant violence targeting trans women of color. The past month has seen a marked increase in the already-high rate of murders targeting this community, leading groundbreaking actress and activist Laverne Cox to declare a state of emergency for trans communities of color.

Ms. Cox describes the structural inequities facing trans women of color, including employment opportunities, housing, and health care. Discrimination in the workplace, in healthcare access, and in housing are well-documented by efforts such as the National Center for Transgender Equality’s survey work. However, the multiplicative effects of white supremacy selectively victimize trans women of color.

In 2015 alone, twenty trans women have been murdered. The overwhelming majority of these women were women of color, and in over half of these cases, no charges have been filed. However, it is likely that this statistic is an underestimate. Often, the bodies of murdered trans women are burned or left to decompose, destroying clothing. Autopsy protocols often identify the victim’s gender based upon anatomy. In these cases, the community members must identify the victim as a trans woman.

As Ms. Cox states, “Your life should not be in danger simply for being who you are.” The killing of Deshawnda Sanchez illustrates the pervasive nature of this violence, as she was killed “pounding on (a) door, seeking help”.

The #SayHerName hashtag has created a movement to recognize and mourn the trans women lost to violence. This hashtag serves two purposes – first, it creates space to memorialize the women lost to violence. However, the hashtag also recognizes that many of these women were disrespected even in death, with many media outlets referring to them as “transvestites” or “men in drag”. This hashtag also recognizes a tactic of anti-Black racism, in which irrelevant mugshot photos are used to identify Black victims of violence, serving as a form of character assassination.

Unfortunately, the rampant murder rates facing trans women of color are only one facet of a much larger system of violence.

Trans women face extreme rates of violence in detention facilities run by Immigrations and Customs Enforcement, due to the practice of detaining trans women along with men. Pressure from activist groups has led ICE to develop new practices, which will detain individuals based upon gender identity. However, the case of Nicoll Hernández-Polanco has shown that prison guards are often complicit in sexual harassment and assault. Furthermore, detained trans women are still vulnerable to administrative segregation in solitary confinement, which is considered a form of torture.

Furthermore, trans women of color suffer racial profiling by police. Officers profile these women as sex workers. In her memoirs, Sylvia Riviera describes police harassment and detention of these women leading up to the Stonewall Riots. But decades after Stonewall, trans women of color are still profiled and detained. The arrest, detention, and acquittal of Monica Jones has brought attention to modern-day profiling of trans women of color. Monica Jones, a Black trans woman, was arrested under the terms of a Phoenix, AZ “manifesting prostitution” ordinance. Grassroots resistance against the ordinance has centered around the extremely vague language and the substantial degree of individual officer judgement involved with its enforcement.

Finally, as people of conscience, we must engage ourselves in solidarity with trans women of color. We must ensure that the nationwide day of action is not interrupted with news of another murder.

Cicilline introduces LGBT protection bill in Congress

Congressman David Cicilline (D- RI) announced historic legislation to expand upon the Civil Rights Act of 1964, and provide protections for the LGBT community in several areas, including public accommodations, housing, employment, federal funding, education, credit, and jury service. Announced in Washington, D.C., the bill, known as the Equality Act, has been introduced in both the House of Representatives and the Senate. There are 157 original cosponsors to the bill in the House, and 40 in the Senate.

“In most states, you can get married on Saturday, post your wedding photos to Facebook on Sunday, and then get fired on Monday just because of who you are. This is completely wrong,” Cicilline said in a press conference. “Fairness and equality are core American values. No American citizen should ever have to live their lives in fear of discrimination.”

Currently, there are 31 states where it is legal to discriminate against someone based on their sexual orientation, and deny them services, employment, or housing.

Cicilline, who is one of seven openly gay members of Congress, added that the Equality Act is common sense legislation that will help to resolve the current patchwork of anti-discrimination laws all over the country.

“Partial equality is not acceptable. It’s time for a comprehensive bill that protects LGBT Americans,” he said.

The Human Rights Campaign, a non-partisan LGBT advocacy group, found that 63 percent of LGBT individuals have been the targets of discrimination in their personal lives. LGBT students have also been made to feel unsafe at school- 82 percent have been verbally harassed, while 38 percent have been physically harassed.

Other members of Congress spoke on the bill as well. Senator Tammy Baldwin (D- WI) said that she believes America is ready for such a comprehensive step.

“No American should be at risk of being fired, evicted from their home, or denied services because of who they are, or who they love,” she said. “We also need to make sure that every American has a fair chance to earn a living and provide for their families.”

Senator Cory Booker (D- NJ), said the act is based on purely American values, even if the reason for its existence isn’t very American at all.

“This legislation that we are introducing is something that resonates with the best of who we are as a nation,” he said. “But the need for this legislation reflects the worst of who we are.”

Representative John Lewis (D-GA) said the act is long overdue, and provides justice for LGBT Americans. He said it will provide them dignity and respect, without fear of being denied things they need for being who they are. Democratic Whip Steny Hoyer (D-MD) echoed these sentiments, saying that he hopes that Congress will take immediate action to pass the bill.

Many outside of government were invited to come share their stories about how they have been denied services just for being gay or transgender. One couple’s pediatrician would not treat their daughter just because they were lesbians, while a transgender man from Texas was fired from his job after being “outed.” Many advocacy groups showed their support as well, including the Human Rights Campaign, the Center for American Progress, and the National Center for Transgender Equality.

“This is a national problem that needs a national solution, and the Equality Act is that solution,” said Winnie Satchelberg, the Executive Vice President of the Center for American Progress.

Only 19 states provide employment and housing protections for LGBT Americans. 17 states prohibit public accommodation discrimination based on sexual orientation or gender identity, and four prohibit it based solely upon sexual orientation. Prohibitions for education discrimination based on sexual orientation or gender identity exist in 14 states.

Gay Boy Scout leaders: Are the scouts free at last?

The announcement on July 13 that the Boy Scouts of America will rescind its longtime ban on gay BoyScouts310and bisexual leaders came to some, including myself, as a notice of victory. I earned my Eagle Scout rank in 2004 and part of my own struggle inching out of the closet had to do with the pain of giving up certain rights and privileges granted me by that designation. Eagle Scouts, upon earning the rank, are expected to remain active in their scout troop and to become civic-minded members of the community.

However, the ban on gay and bisexual leadership, which had the despicable insinuation that same-sex attracted leaders might be prone to child victimization, was a barrier that has continued to hinder my own participation. Much of this can be attributed to the demographics of the scouting movement. For years, it has been extremely suburban and white, with a large majority of the membership belonging to the Church of Jesus Christ of Latter-Day Saints, which effectively turned a multi-denominational organization into a Mormon youth program due to their own utility of the Scout troops as a sort of religious obligation. Whereas my parents were active in my troop voluntarily, the Mormons actually assign leaders to troops as a variation of their two-year missionary program. Some young men may wind up in South America building schools and hospitals while others end up in Kansas trying to handle a pack of young men in the grips of hormonal fury. I’m not a Mormon, so I have no idea about the dynamics of such things, but I’d happily take a malarial swamp over a random Scout troop any day of the week.

But despite these advances into the new century, there remain several issues at hand that the Scouts should be willing to address next, lest it become a relic by the end of the century. As a forewarning, one thing I adamantly oppose would be a merger with the Girl Scouts, that is simply begging for a teen pregnancy, STI, and sexual assault epidemic within the organization. When you are dealing with boys in the age range of 11-18 who are guided by the maxim of ‘boys leading boys’, the last thing they need in the middle of the woods is an opportunity for carnal delights. If that makes me sound like a sexist dinosaur, so be it, my concern is primarily out of safety for the girls. When I was in Scouts, I went through a period of hazing that was pretty rough, but I survived it. Only the morbid fantasies of a child pornographer might match the depravity possible were it tenable for the middle-year adolescents who picked on me to get their hands on an 11-year-old girl instead.

First, it might do the program some serious good to revise the curriculum related to all things Native American. One of the first merit badges I earned was Indian Lore, which consisted of recycling tired mythos about America’s indigenous population. While there was plenty of worship of the mythical and magical, there was nary a discussion of the genocide that came along with the white man. Any mention of the Trail of Tears, Wounded Knee, or Sitting Bull was brushed aside, while modern issues related to the native peoples, such as the plight of Leonard Peltier, the American Indian Movement, or the capture of Alcatraz Island, were simply tabooed. This could be revised with some honesty and the discussion could be made relevant to reality instead of having as much veracity as the Natty Bumpoo novels.

Second, in connection with this point, there would be a great benefit if the troops offered a more honest appraisal of Euro-American imperialism, particularly as related to the movement’s founder, Robert Baden-Powell. Besides the unfathomably weird aspects of his private life, the man’s military career reads like Queen Victoria’s greatest hits. He was stationed in India, Malta, and South Africa during some of the most violent moments of the Empire and is alleged to have performed some kind of espionage during the First World War. Would the world come to an end if the Scouts offered an honest explanation of what led to World War I? Some years ago, I had the opportunity to participate in a job training program for a Scout camp that, thankfully, I quickly left. As far as the eye could see were bumper stickers that have become trademarks of the Tea Party. The level of embedded racism is so virulent that only the deranged can avoid it. And furthermore, this is not new ground to tread. Already in California, the ‘Radical Brownies’ have taken the basic tenets of the Girl Scouts and flipped everything upside down, creating curriculums that tell the history of the Black Panthers, headgear worn in homage to the Brown Berets, and an LGBT Ally merit badge.

Third, urbanize the program. The population trends of the next century point to a status quo where the largest potential swathe of membership will come from the cities. Indeed, any reasonable sort of cultural modifications meant to abate climate change will come about from the mass-migration from the suburbs to the city. Camping and hiking will remain staples of those who want a weekend escape from the pandemonium, but the majority of human existence will take place in metropolitan centers like New York or Los Angeles. There is ample room for an adaptation of David Harvey’s theories about the right to the city, small-d democratic notions about found spaces, and citizenship within the context of the urban sprawl. This will also bring about an influx of young men of color, something especially needed in Boy Scouting, which up until now has been the junior shock troop contingent of the Caucasian Invasion.

Finally, divorce the fire arms training curriculum from anything remotely close to the NRA. I can understand the logic of teaching young men to use a gun. But being allied with the lobby of gun manufacturers rather than gun owners is simply insane. The NRA ceased to be anything but the voice of the firearm corporations years ago and does not care about the safety of young people when it comes to weapons. Every day the program has anything to do with this morally-repugnant group is a blemish on it. This is de facto approval of a Congressional lobby steeped in the most reactionary, childish, and bigoted worldview this side of a burning cross. There is no reason for this partnership to continue.

There are extremely important things about scouting that should not be jettisoned. The citizenship merit badges, required for the Eagle rank, are some of the most vital lessons in civics I ever gained. The annual Scouting for Food, usually held the first weekend after Halloween, is a massive success that brings tons of foodstuffs to pantries across America at the outset of the holiday season, something direly necessary. The scouting movement has been especially ahead of the curve on all things ecological and environmental, with training that included mention of global warming well before Al Gore exposed the inconvenient truths of our carbon footprint in the cinema. I discovered my own vocation, film making, through the cinematography merit badge that was formulated by Steven Spielberg, while another fellow Eagle from my troop found his own career path in part thanks to the Lifeguard BSA training. The Boy Scouts of America is not going to easily disappear from our landscape. Rather, it is the duty especially of Eagles like myself that are now allowed to return to the Troops to bring with us a set of moral and ideological coordinates gained from LGBTQQI liberation movements that will successfully guide it on a course through the next century.

RI General Assembly still voting on marriage equality

DSC_3469Marriage equality has been the law in Rhode Island for two years now, and its gone nationwide due to the recent SCOTUS decision, but in the General Assembly, some legislators are continuing to vote against same-sex couples seeking to get married.

When the General Assembly abruptly ended its legislative season this year, it did so having passed 117 “Solemnization of Marriage” bills. These bills are perfunctory legislative favors done by Representatives and Senators for their constituents. Essentially, if a couple wishes to be married, but the officiant of their dreams is not permitted to marry the couple by law, a “Solemnization of Marriage” bill allows a one time exception.

With this bill passed, a beloved relative or family friend will now be able to conduct the wedding ceremony. Because these bills are so common, they are usually bundled together as part of a “consent calendar” which is passed with little discussion and no fanfare.

Many who voted against same-sex marriage two years ago continue that battle today and some new legislators have joined the fight by voting against solemnization of marriage bills for same-sex couples. This means that anyone seeking these perfunctory legislative favors are now putting themselves in a position to have their marriage judged by religious conservatives. These votes served to remind 25 couples that their marriage is not worthy of the same level of respect as others.

Out of the 117 solemnization bills passed last year, six were for couples with names that are traditionally associated with the same sex. Misty and Dawn, Elizabeth and Nancy, Alicia and Laura, William and Michael, Kristin and Rebecca, and Emilie and Michelle all sought and received solemnization of marriage bills. Two other couples, Sarah and Chris and Rebeccah and Alex may or not be same-sex couples, judging from the names. Of course, perusing the names like this is by no means a perfect system, so I apologize if I have missed or mischaracterized anyone based solely on a heteronormative reading of their name.

Consistently voting against same-sex marriages are Representatives Samuel Azzinaro, Arthur Corvese and Robert Phillips. Reps Justin Price, Joseph Trillo, Robert Lancia and Sherry Roberts frequently vote against same-sex solemnization bills.

Because solemnization bills are frequently bundled and passed together on a consent calendar, oftentimes these legislators find themselves voting against opposite sex marriages that happen to be part of a bundle that contains just one same-sex marriage. On May 19 Azzinaro, Corvese, Lancia, Phillips, Price, Roberts and Trillo voted against 5 marriages in total because William wanted to marry Michael. And On May 12 Azzinaro, Corvese, Phillips, Price and Trillo voted against 6 marriages because Alicia wanted to marry Rose.

I spoke by phone with Rep. Azzinaro, a Democrat serving District 37 in Westerly, about his no votes, which he says are based on his religious beliefs. Azzinaro introduced 7 solemnization bills last season, all of which passed without a single no vote.

“It’s not in my belief,” said Azzinaro about same sex marriage, “I didn’t vote for it when it was brought to the House for a vote and I don’t feel I can vote for any of these same-sex marriages.”

I asked how legislators determine which bills are for same-sex marriages and which are for opposite sex marriages. “We usually try to find out also from the sponsor of the bill if it’s a male and a female or a same-sex couple marriage, if we’re not sure,” Azzinaro said.

He went on to say that if a same sex couple in his district came to him and asked him to submit a solemnization of marriage bill before the House, he would tell them no. I asked him how he thinks his constituents would feel about that, given that he discriminates against his same-sex constituents in what kind of services he offers, based on their sexual orientation.

“They have to know who I am, how I feel,” he said.

??????????Well, it’s hard to say for sure since we can neither read nor change the past. The disgraced former Mayor of Central Falls, who plead guilty to corruption charges in 2012, and one of the key factors in Central Falls declaring bankruptcy in 2011, might be in favor of having the rainbow flag fly over city hall.

But few residents really care what he thinks these days. The same is true for former Mayor Lazieh, who also “helped” the city along on its path to bankruptcy back in the 1990s, and who has tried to return to the post only to be defeated by James Diossa in 2012, and to the City Council in 2014 – again, defeated by voters presumably unwilling to make the same mistakes made in the past.

What does matter is that three years into his administration Diossa is continuing to bring his home town into the 21st century by celebrating Central Falls’ diversity across the board. And that includes recognizing the place that Central Falls’ gay residents have in this city that still defiantly calls itself “the city with a bright future.”

This is the second year that Diossa has raised the rainbow flag, the symbol of the LGBTQ community since the 1970s. He joins Providence Mayor Jorge Elorza who raised the flag on June 5 to kick off Rhode Island Pride season.

The group that gathered at this flag raising ceremony was small but inclusive – Hispanic, Anglo, African American, current and former residents – and all were openly delighted. There were also representatives from Senator Whitehouse’s office, as well as city officials and employees, and a representative from Governor Raimondo’s office.

This ceremony seemed particularly significant, held on the day before the Supreme Court ruled 5-4 in favor of marriage equality across the United States. In his remarks, Diossa talked about the importance of recognizing ALL residents of the city.

??????????“Our LGBTQ community deserves to be recognized with a symbol that is known and flown proudly all over the world,” he said. In speaking to me after the ceremony, he said “I really don’t understand what the big deal is.” For him, the “big deal” is the importance of people loving each other and that it be recognized socially and legally.

There are no statistics on how large the Central Falls gay population is. Doesn’t matter.

What’s important is that, in an age where marriage equality is law across the United States, and more and more Americans now support it, the small city of Central Falls is striking a solid blow that firmly asserts that diversity comes in all forms.

This is almost revolutionary in a city that was once a densely Catholic bastion of conservative social values and dominated by Anglo ethnic groups (French Canadian, Middle Eastern, Polish, and the like) that didn’t even welcome the “invasion” of Hispanics into “their” town.

Mayor Diossa is no stranger to embracing gay rights. In 2013 he joined several other Rhode Island mayors in supporting the legalization of gay marriage here. That support undoubtedly helped the bill pass and become law. Quoted in an article posted on the gay rights organization Human Rights Campaign website , he said “Marriage tells our communities that two people are uniquely committed to one another – that they are a family.”

What is interesting is that Central Falls is now predominantly Hispanic at 65.7%, an ethnic group not historically noted for its support of gay rights. That appears to be changing. A recent Pew Center study found that Hispanics have joined the ranks of supporters of marriage equality at 56%.

This is possibly the result of millennials (age 18-34) now being counted as a force to be reckoned with, likely undercutting traditional social conservative values of their elders. Or it’s possible that Hispanics, who are experiencing ethnic backlash in several states such as Arizona and Texas, even as their political clout has grown, realize it’s time to join with other minorities and support their battles.

An article on the Pew Center website discusses how Hispanic values are changing, thanks to fluctuating religious identities and experiences.

However, that doesn’t mean that Central Falls Hispanics would look kindly upon gay rights. Well aware that raising the flag might offend this predominantly Hispanic city, Diossa, who is of Colombian heritage, cares only that the city recognizes diversity, saying that Central Falls has always been a “gateway city,” where immigrants and minorities can create new lives, and that celebrating gay rights is simply one more way to celebrate the city’s residents.

He made a point of referencing opponents – “Despite the open and loving arms of Central Falls residents, there are still some who whose acceptance of our neighbors is limited.”

Some former and current residents are delighted. Central Falls native and current Riverside resident Ricky Gagnon was glad to hear about the flag raising, saying in a Facebook post “Very cool that my old hood is catching up to being trendy like me.” Central Falls resident Kelly F, declining to give her full name, was at the ceremony and thrilled to see it happen. She said, “This means that maybe my wife and I will finally be fully accepted in my hometown.”

Others of an older, predominantly Anglo, generation mourn the loss of morals in a city slipping out of their control. A woman who lives in one of the two public senior and disabled housing complexes was heard to say that this definitely would not have happened if Moreau or the former City Council was still around. Or any of the other perennial Central Falls politicos. Another called the whole affair “sick.”

It can’t be easy to be on the losing side of social progress, of course, or the wrong side of history. The sky is certainly falling for those who dig in their heels and cry for ‘the good old days’ when men were men, women knew their place, and gays were considered morally corrupt.

Those days are disappearing in the rear view mirror, and rainbows are the order of the day in Central Falls. And as a resident of this small but fierce urban survivor, I couldn’t be more proud.

Rhode Island’s celebration of the Supreme Court‘s historic decision allowing same-sex couples to marry across the United States was also a history lesson about the long battle for full LGBTQ acceptance in our state. Organizer Kate Monteiro spoke eloquently and introduced a steady stream of speakers, but more importantly she paused to remember those who didn’t live long enough to see this day, those who are only spoken of “in the echoes of the wind.”

We live in a better world because of their work and sacrifice.

The celebration was held at the Roger Williams National Memorial, because, explained Monteiro, this is where “religious freedom in the United States was born” and where Belle Pelegrino and the ’76ers first met to demand the right to march in Providence with a sign saying ‘I am gay.'”

“We stand at the top of a very, very high hill,” said Monteiro, “we have carried that pack and we have wanted for water and struggled and slipped and we stand at the top of a hill. And the view is beautiful. It is absolutely splendid. And just a little bit further is the next big hill. Because we are not at the top of the mountain, never mind the other side of the mountain.”

“Tomorrow, in 29 states, someone can be fired for being gay or lesbian, let alone transgender. (That, thank you, is 32 states)… That’s wrong, we need to change it, that is the mountain.”

“Can you imagine if we could go in time and bring Roger Williams here today?” asked Rodney Davis to laughs, “but when you boil it down and get to its purest sense, Freedom, Liberty and Justice was the reason why he came here…”

rev geneAs leaders of faith communities that uphold same-sex marriage, we are delighted that the Supreme Court of the United States has ruled in favor of inclusion of all American Couples.  Now, all couples will enjoy the same rights and benefits.

From a religious perspective, affirmation of same-sex marriage is fundamentally about love and the recognition of the dignity of all people.  The bible teaches that God created every human being in the divine image and every one of us is a manifestation of God’s goodness and beauty.   All couples have the potential to be holy and they deserve our support and encouragement.  Biblical teaching is clear that the greatest commandment is to love God with all our hearts and to love one another as we love ourselves.

As pastors, we value all the families in our congregations and we are pleased that the hurt and the stigma that always comes with inequality has been removed.  Jesus taught a message of love and inclusion.  We can only be pleased that the Supreme Court of the United States, through reasoning with a totally secular perspective, has concurred.

We remember fondly the many advocates who have given voice to a demand for justice.   We recall with gratitude the legislators in the Rhode Island General Assembly who took a reasoned stand for fairness and a supportive Governor who signed the bill.

We pray for people of conscience who may struggle with this decision.  We call for mutual respect, civility and understanding among all people of faith.  Reacting with rejection and negation will not lead to a healing solution.  Tolerance requires respect not agreement.  Let us embrace each other lovingly in a spirit of humility.  Especially in Rhode Island, where tolerance is in our cultural DNA.

IndiVISIBLE: RI Pride is radicalized

DSC_3225The theme for RI Pride‘s 2015 celebration, suggested by Anthony Maselli, Mr. Gay Rhode Island 2014,  was “IndiVISIBLE.” I’ll let Maselli explain it in his own words:

“Each year we are inching closer to full legislative equality. But legislative equality does not equal acceptance and it does not equal security. With the constant attacks around women’s rights, Transgender rights, racial disparity, HIV criminalization, immigrant’s rights, income inequality, poverty and homelessness, we need to wake up to the fact that marriage equality, while important, is in some respects just the shiny object that the government is dangling in front of us while leading us off the edge of a cliff.

“This is not our end game. It never has been.

“The term IndiVISIBLE was meant in part as a shout-out to the SCOTUS case, because when one hears the word ‘IndiVISIBLE’ one typically thinks of the phrase that follows it, ‘with liberty and justice for all.’

“But the teem IndiVISIBLE was also suggested to remind that without equal attention paid to all these other issues that affect us, without a shift of focus beyond marriage rights and onto a broader queer convergence movement, we really have nothing.”

Maselli’s words were just the beginning. He then introduced Josh Kilby, who began his talk with “Happy pride, comrades!” Kilby talked about the gains made in recent years by the LGBTQ community in terms of military service (unless you are Trans) but pointed out that the community “fought this battle without questioning the utter devastation the U.S. Empire causes around the world.”

The new frontier of the Queer rights movement, said Kilby, is that, “We stand in unconditional solidarity with ‘Black Lives Matter,’ for unrestricted, free abortion on demand and without apology, for free access to Pre-Exposure Prophylaxis to anyone who feels they need it and without judgement, and most importantly, we do not tolerate racism, sexism, transphobia in our community at all.”

R. (Ronald) Lewis, poet and performer, then delivered a blistering broadside, that has to be heard to be experienced. Lewis goes after capitalism, which, “commodifies the unconquerable” and he goes after the sanitized history of the Stonewall Riot, pointing out that Stonewall is now a place that celebrates “Gay” liberation without mention of, as Rachel Simon says in her piece, “Sylvia Riviera and Marsha P. Johnson, two trans women of color who were the first to resist arrest on the fateful night.”

When I first arrived at Pride, Anthony Maselli told me that I should be at the stage at 4:30, because he was part of a plan to “radicalize Pride.” It’s this next bit that stirred to crowd to wild cheers, and outraged protest. When Maselli said, “It’s time for us to dispel the bitter myth that we, (the queer community) are all men, all wealthy, and all white, because that is not the majority of who we are,” a man in the crowd shouted, without apparent irony, “That’s a lie! You don’t know what you’re talking about!”

“We are under attack,” said Maselli, “by the religious, cultural, economic and political right that targets LGBTQ people, women’s economic, reproductive and sexual freedoms, and is organized around a racalized notion of national culture. A religious freedom framework is being deployed to undermine all civil rights laws.”

Maselli asks, “Rhode Island has marriage, now where do we go from here?” and answers, “We are queering living wages, access to health care and transgender justice. Queering total immigration reform and ending incarceration. We are queering feminism, queering the way we talk about race, queering HIV activism, queering heteronormative ideas of marriage and couplehood, queerly engaging in radical protest, getting old queerly. We need to create a movement that says not only, ‘We’re here, we’re queer, get used to it’ but one that says “Join us, dream with us, dare with us, go for broke, and change the world.’

“What if IndiVISIBLE was more than just a word printed on a tee shirt, what if this was our queer vision for what we do next?”

PrYSM demands racial and immigrant justice at RI Pride

Saturday’s Pride parade and festival marked almost two years since the legalization of same sex marriage in Rhode Island. There was an air of celebration, with live music, dancing, and plenty of displays from large corporate sponsors. However, activists from PrYSM (the Providence Youth and Student Movement), supported by DARE (Direct Action for Rights and Equality), marched in the parade to demand racial and immigration justice.

The history of Stonewall was alluded to throughout the event. But fifty feet in front of Bank of America’s procession, Ron Lewis and José Lamoso reclaimed Stonewall, centering the narrative around Sylvia Riviera and Marsha P. Johnson, two trans women of color who were the first to resist arrest on the fateful night.

Johnson and Riviera were the first to stand up against the police, and the first to be excluded from the Gay Rights movement when they were deemed unacceptable.

After Lewis and Lamoso finished speaking, PrYSM’s float showed how gender and race become criminalized, subjecting queer and trans immigrants and people of color to police violence and harassment.

#FreeNicoll is a movement aimed at securing the release of Nicoll Hernandez-Polanco, a trans woman from Guatemala who traveled to the United States seeking asylum. Ms. Hernandez-Polanco was detained in an all-male wing for six months between her arrival in October 2014 and her bonded release on April 22nd, 2015. As a result of this placement, she experienced abuse from her male guards, including offensive comments and gestures. Hernandez-Polanco has stated that she experienced multiple incidents of being groped by the prison staff. Her $3000 bond was gathered by a successful crowdfunding effort. Her asylum request was granted after she was released. However, Justice Department statistics show that less than six percent of the asylum applications received in Fiscal Year 2015 were granted.

The detention of Ms. Hernandez-Polanco illustrates major shortcomings with the State Department’s LGBT policies. Her asylum request was granted after six months of pressure from immigration and trans activists. However, the State Department has not issued any guidance specific to transgender asylum seekers. Five months prior to Ms. Hernandez-Polanco’s detention, the State Department issued a press release detailing its position on LGBT rights issues. However, the listed policy objectives were primarily limited to lobbying foreign governments to decriminalize same-sex conduct between consenting adults. This stated policy does not address the myriad of legal issues and governmental abuses that are specific to transgender people, including detention policies, access to medical care, and policies to change name and legal gender assignment. While the State Department had implemented a LGBT training program for personnel managing refugees and asylum seekers as of May 2014; this training program was only mandatory for new hires. It is not clear how many of the personnel in the Arizona office, where Hernandez-Polanco arrived, had received this training.

5mb-7687However, the US government’s lack of trans-specific guidelines and accountability affects many other government agencies. TSA screening policies require all passengers to submit to some form of security screening. Passengers can choose between the TSA’s Advanced Imaging Technology (AIT) machines, which image the body electronically, or undergoing a pat-down examination. However, both of these present specific challenges to the transgender community. The TSA has upgraded the current inventory of AIT machines with automated threat detection software after years of lobbying by privacy advocates. Previous technology presented a TSA officer with explicit imagery of the passenger’s body, including breasts and genitalia. According to the TSA, the automated systems are capable of detecting specific threats (for example, an object shaped like a gun or a knife) and then overlaying this threat on a generic human outline. However, the system requires the operator to enter the sex of the passenger.

For some transgender people, this may result in genital and breast areas registering as “anomalies,” requiring invasive examination by a TSA officer. This can also be caused by body-shaping garments such as binders, which are commonly used in the trans community to reduce the size and appearance of breasts.

The National Center for Transgender Equality (NCTE) has collected data on the experiences of transgender passengers as part of the National Transgender Discrimination Survey (NTDS). The survey showed almost 20% of transgender people have experienced harassment or disrespect associated with security or other check-in processes. The TSA has created a training program addressing trans issues. However, this program is intended for use only by individuals tasked with passenger support, not by the screening officers themselves.

5mb-7718Next, the float addressed the realities of police violence and profiling, as experienced by queer and trans people of color.

5mb-7686Throughout 2015, far too many youth of color have had their names become hashtags as they are the latest victims of police violence. Jessie Hernandez was a 16 year old queer Latina who was killed by a police officer. Over the last year, the LGBT community has publicly mourned the tragic suicides of those who were lost. Leelah Alcorn’s death was observed, though often the response was dominated by the non-trans majority in the LGBT world. However, it is necessary to acknowledge the tragedy of LGBT youth killed by police violence.

Police profiling is a major concern for trans women of color, who are profiled and subject to detainment as perceived sex workers. In Phoenix, Arizona, a campaign has been built around Monica Jones, a Black trans women who was arrested under Phoenix’s “manifesting prostitution” ordinance. Jones’ conviction was vacated in January 2015 when it was determined that she did not receive a fair trial. The ACLU and local activists have decried the ordinance, which criminalizes intent to sell sex. The ordinance defines “engaging passer-by in conversation” and “asking if someone is a police officer” as intent, even though there are many other contexts in which these actions could occur. In this case, the arrest is made at the discretion of the officer, and the officer’s prejudices.

Jones’ trial brought media attention to the profiling experienced by trans women of color. In this case, Jones was brought to trial. However, this suspicion of being a sex worker provides probable cause to question and temporarily detain trans women of color, and is hardly limited to Arizona.

DARE and PrYSM collaborated to draw attention to the Community Safety Act, a multi-faceted proposed law addressing community concerns about policing. The law contains provisions to ensure all police-citizen interactions are recorded, and that these recordings are available to the public. Having all stops documented would show whether or not Providence police were profiling trans women of color as sex workers. Furthermore, the law contains language to establish protocols during traffic stops, and define protocols for tracking individuals as part of a list of suspected gang members.

Finally, the march demanded accountability for the deaths and suffering of queer and transgender people of color.

Rest in Power is a call to mourning and a call to action. Before a death is mourned, many times the deceased must be reclaimed from a media bent on misgendering trans people, or engaging in character assassination against people of color killed by police.

The theme for the 2015 Pride march was “indiVISIBLE”. In the President’s welcome message, RI Pride President Kurt Bagley compared drew parallels between the efforts to advance LGBT equality with the uprisings in Ferguson, MO and Baltimore, MD. The appeal to justice is romantic, but these simplistic comparisons ignore the efforts of queer and trans activists of color. Pride, as an organization, is quick to appeal to Stonewall’s revolutionary nature, centered around resisting police brutality and profiling. Unfortunately, the LGBT community is quick to disavow the police violence experienced today by queer and trans people of color.

Boston’s 2015 Pride March was disrupted by a group called Boston Pride Resistance. A sit it was held, blocking the parade route for eleven minutes. The eleven minute duration was chosen to recognize the lives of the eleven trans women of color murdered, to date, in 2015. Using the hashtag #WickedPissed (a counterpart to #WickedProud), the group demanded greater inclusion of queer and trans people of color. Over a decade after Massachusetts legalized same sex marriage, the group drew attention to inequalities still experienced by LGBT people.

Ten years after Stonewall, activists such as Marsha P. Johnson recalled how the gay rights movement had become less radical. Even before Stonewall, early American gay rights groups such as the Mattachine Society were quick to adopt policies of assimilation. Across the country, middle-class, white gay people are awaiting a verdict in Obergefell v. Hodges, which is hoped to make marriage equality the law of the land. But for the queer and trans activists fighting against the criminalization of race, gender, and poverty, marriage equality is a victory for a different world. If Rhode Island’s LGBT community is to be truly “indiVISIBLE”, it must first acknowledge these struggles. If President Bagley is seeking the revolutionary spirit of Stonewall, 1969, he will find it in Providence, 2015, with direct action movements challenging over-policing and police violence almost fifty years later.

Scratch that we can be a bit more specific here—This letter is for those who claim to love Black womanhood — our collective passion, histories, political work, bodies, and victories — but do not love Black women. This is for everyone and anyone whose rhetoric is stronger than their action.

We would love to open this with an epigraph — a portion of poetry from Lorde or Shakur—but I fear that would soften the coming words. This is not a message that will be sugar-coated. You should not feel good about yourself for showing up to this vigil or for reading this letter. This event is not your chance to practice abstract revolutionary theory. Black women in Providence are hurting, and we have been hurt and forgotten most remarkably by those who claim to be supporters and allies.

In the process of creating and planning this event to honor Black women’s lives who have been lost we ran into an all too common problem. Sitting and planning, we quickly found ourselves asking, “But where are the others?” There is no question that there will be an audience at the event itself, particularly in a community such as Providence where a political event is unlikely to have only a few in attendance. But, when people attend for the product but do not really assist in its creation, it is easy for this phenomenon to feel like another way various individuals and groups siphon off of the work and energies of Black women. What we create is good enough to be consumed, but what about us?

We could pin this scenario on the age old trope of the strong Black woman. Many people do not assume that Black women need help. They believe we’ve got this shit locked down. Or, they do not recognize our pain and our need for help and care. It is unlikely that these thoughts are in the forefront of any of our so-called allies’ minds. It is more likely that these thoughts are subconscious feelings that guide their (in)action. Conscious or subconscious, this belief that Black women are beyond help — perhaps the public assumes Black women are able to handle our suffering by ourselves or has decided that we just aren’t a priority in the grand scheme of liberation politics — is so incredibly violent and has the ability to cause irrevocable damage. To be surrounded by people who have the same general beliefs as us, who cry the same rallying cries of “Liberation” and “Revolution,” and yet are nowhere to be found when we need them, leaves us in an exhausting predicament. We are exhausted.

This is to everyone and anyone who has ever underestimated, overestimated, or simply did not care about the Black women who surround them, while highlighting, quoting, and screaming the words of the Black women revolutionaries they’ve chosen to mythologize. This habit of calling for liberation all the while leaving your Black sisters all around you absent of your care is not sustainable. This is not how we build a sustainable community. And please do not listen to these words and snap and cheer and think to yourself “Preach! And oh, I know they’re not talking about me, they couldn’t possibly be”. Because, we are. These words are for everyone. Take a step back and think. Really, think through your past and future actions think about your interpersonal engagements with Black people— particularly Black women! Really reflect on how you have treated us. Look for the inconsistencies. Look for where your words and your actions do not match up. Do better. Build with us. Truly build with us, not on our backs but alongside us.

More than 100 people gathered in India Point Park in Providence Friday evening for a Juneteenth vigil “to pay respects, mourn, honor, and acknowledge our fallen Black Cis and Trans Sisters who have lost their lives and freedom at the hands of the Police State.” Participants cast flowers into the Bay to remember the lives lost, and to honor their memories.

The event was described by organizers as a “vigil for the lives that are too often forgotten or pushed aside. The names who do not get chants, the faces who do not get to be transformed into posters, the people who are not chosen for Million Marches.”

Organizer Monay McNeil opened the space by reading a poem by Lucille Clifton.

Organizer Andrea Sterling delivered a powerful opening statement, saying, “We will acknowledge the ways in which society has deputized those even without badges to police Black bodies, Black women, and we’ll speak against that kind of police violence and terror as well.”

Organizer Helen McDonald shared thoughts about the recent shooting in Charleston, that took nine lives, including six Black women. “…attacking the black church is more than an attack on a physical space. It is an attack on a people, on a culture, on a history and on a legacy. Importantly, an attack on the Black church is an attack on Black women…”

Organizer Dania Sanchez then asked participants to speak the names of women who lost their lives to police violence. There were too many names spoken, and the list was of course not complete. Many those named were commemorated on the beautiful signs and posters brought by members of the Providence Youth Student Movement (PrYSM).

Participants were then invited to cast flowers into the water, to symbolize and commemorate the lives of Black women who have lost their lives to police violence.

The event closed out with a powerful open letter from all the organizers, Andrea, Dania, Helen and Monay, to “those who claim to love Black womanhood — our collective passion, histories, political work, bodies, and victories — but do not love Black women.”

DSC_9301When I think of the millions of people around this country, and around the world who have put in countless hours of effort to bring the right to marry to queer people, I am thoughtful of the possibilities of what can be accomplished when oppressed humans and their allies come together to effect change.

When I think about our state, and the 30+ thousand people who will come here for Rhode Island Pride weekend, I feel overwhelmed and personally grateful that a lonely and isolated gay boy from a violent, fundamentalist household in Newington, Connecticut, could move to a city only 80 miles east, and find a home here with people who love and support me. For most of my life, I had no sense of connection to the terms “community” or “family”. It was a long and intense struggle, but finally, I have been able to find those things here.

For every one of me though, there are so many more who will never have that opportunity.

There’s a transgender girl out there living in darkness and depression, who will commit suicide before she can graduate high school, because her parents and her church will tell her that that which she has no control over is an abomination, and her classmates and teachers will convince her that she is a freak and a mistake.

There’s a queer Black young man out there who, unable to find intersectional support in a society of singular identity politics, has already given up on planning a future because the concurrence of being a racial and sexual minority places him in multiple zones of peril that frustrate any hope of achievement.

These are not isolated cases; and these are not hypothetical situations- these are American realities.

We have some questions we must ask ourselves:

DSC_9230How could we continue to advocate for marriage equality and LGBTQ inclusion in general, but remain afraid to discuss issues of gender and race within our own community?

How can a dialogue about the experiences of LGBTQ people of color inform our work within the larger queer communities?

How can our successes in advancing LGBTQ inclusion enhance our advocacy for racial and gender equity?

How can arguments for LGBTQ inclusion be used to shift our discussions about race and gender in creative and more effective directions?

By attending to these questions framed by intersectionality, we shift the dialogue to move beyond single labels for us all, and better advance a true and inclusive diversity agenda.

DSC_9231When I suggested the term “Indivisible” for this year’s Pride theme, I meant for it not simply to promote a sense of unity, but to really challenge us to ask these questions, to allow a conceptualization of diversity that moves beyond binary dimensions, and expands to include a three-dimensional sense of self and community.

In closing, I’m going to share with you one of my favorite quotes by Sir Winston Churchill as the rainbow pride flag is unfurled down these steps, but I first want to acknowledge all of the effort that has been made, and that will continue to be made, by some of the people here today.

At times we can become discouraged and lose hope at the slow speed of progress despite our fullest investment. Sometimes, we can put all of our energy behind a cause and still not be rewarded with visible change in our lifetime. But we continue to do it anyway. And it is words like these that encourage us to keep going:

What is the use of living, if it be not to strive for noble causes and to make this world a better place for those who will live in it after we are gone? How else can we put ourselves in harmonious relation with the great verities and consolations of the infinite and eternal? And I avow my faith that we are marching toward better days. Humanity will not be cast down. We are going on swinging bravely forward along the grand high road, and already behind the distant mountains is the promise of the sun.”

DSC_9209Mayor Jorge Elorza helped to unfurl the rainbow Pride flag on the steps of the Providence City Hall as a crowd of about 75 members and supporters of the Providence area LGBTQ community applauded.

Kurt Bagley, president of Rhode Island Pride, introduced the mayor who spoke of Providence as a city that is accepting and supportive of people regardless of their sexual orientation. Elorza was especially proud of his recent move to include transition-related healthcare coverage for all city employees, current and retired, who identify as transgender or gender non-conforming.

The mayor noted that RI PrideFest and the Illuminated Night Time Pride Parade was coming up in two weeks, (June 20) but called special attention to his signature 2015 Providence International Arts Festival, which will will take up the length of Washington St and much of Kennedy Plaza next week.

Elorza took special note of his Deputy Chief of Staff, Marisa O’Gara, recently named Providence’s LGBTQ Liaison.

Anthony Maselli, an AIDs activist, LGBTQ activist and former Mr. Gay Rhode Island, presented a moving address to the crowd, recalling his youth in Connecticut growing up in a conservative religious family and a community that did not accept him. “I feel overwhelmed and personally grateful that a lonely and isolated gay boy from a violent, fundamentalist household in Newington, Connecticut, could move to a city only 80 miles east, and find a home here with people who love and support me,” said Maselli, “For most of my life, I had no sense of connection to the terms ‘community’ or ‘family’. Joining the speakers on the stage were Miss Trans Rhode Island, Alejandra Blaze and Miss Bisexual Rhode island Amber Guzman. They are they first to hold their respective titles, which were created this year in an attempt at greater inclusion in the LGBTQ community.

LGBTQ community protests Haven Brothers hate crime

DSC_6927About 25 people assembled on the steps of Providence City Hall Saturday evening to protest an apparent hate crime that took place in and outside of Haven Brothers diner on April 26. According to a report on Channel 10 News, Joey Catanzaro was assaulted inside Haven Brothers and then asked to leave the premises. Catanzaro wanted to stay inside the diner until the police arrived, but maintains that he was threatened and forced outside, where “associates” of his attackers proceeded to beat him into unconsciousness.

“We want accountability,” said C. Kelly Smith, one of the protest organizers. “I recommend that the LGBTQ and allied community boycott the Haven Brothers until such time as we get an explanation and justice for Joey.”

According to another speaker, Catanzaro was unable to attend the protest “because he is suffering from severe head trauma,” but that he was appreciative of the support from the LGBTQ community.

Former state Representative (and candidate for Lt. Governor) Frank Ferri was in attendance, and said that he has confidence that the police will bring justice for this crime.

Anthony Maselli lamented that a hate crime committed against a gay man in 2011 remains unsolved. “I’m not here to tell you that all the police are bad people,” said Maselli, “I’m here to tell you that the police are not our public servants but are slaves to a system that is stacked against us.”

Attendance at the Haven Brothers protest was undoubtedly impacted by the 500 person strong Black Lives Matter march that was happening in Providence from 3 to 6pm. Organizers are planning more events outside Haven Brothers in the future.

Haven Brothers is a Providence landmark. Established as a horse drawn restaurant in 1888, it is one of the oldest restaurants on wheels in the world. According to Channel 10 News, “One of the owners of Haven Brothers told NBC 10 News that he was told about the incident inside the trailer and was upset. He said he did not know that the victim was thrown out, even though he said he felt unsafe leaving the truck.”

Tony Gugliotta of Channel 10 News reported:

DSC_6930[Joe] Catanzaro, 24, said he was being bullied for being gay, and as a result, suffered serious head trauma and other injuries.

“There were two guys in line making fun of me. They were making fun of my hat — it was a velvet red hat — so I stood up for myself, asked them why they were bullying,” Catanzaro said.

That set one of them off, according to Catanzaro. He was attacked and choked by one of them inside the truck. Patrons pulled the attacker away, and Haven Brothers employees asked Catanzaro to leave.

“I told them I wasn’t leaving the trailer until the cops came, and I was calling the cops. And one of the cooks from the grill came up to me with a butcher knife and said, ‘Get the hell out of the trailer,'” Catanzaro said.

Catanzaro left and was met by several other associates of the men inside. They continued to beat him unconscious, and according to witnesses, didn’t stop there — kicking him as he lay motionless on the ground before fleeing the area.

Cicilline to sponsor LGBT civil rights bill; would trump state RFRA laws

cicillineRhode Island Congressman David Cicilline is drafting a bill with Senator Jeff Merkley of Oregon that would extend civil rights protections to LGBT people, he explained in an interview with RI Future.

The bill, long in the works, he said, would prevent states like Indiana from using so-called “religious liberty” laws to sanction discrimination based on sexual orientation.

“Many of us started to feel that the time had come to approach LGBT equality in a different way,” Cicilline said. “Why aren’t we putting together a comprehensive bill that prohibits discrimination against the LGBT community, period? We looked at a variety of federal protections that exist in the civil rights area based on race, and gender, and ethnic origin and religious tradition … why don’t we just add sexual orientation and gender identity to those existing categories that are protected from discrimination.”

Cicilline is co-chair of the LGBT Equality Caucus and, according to a press release, “one of six openly gay Members of the U.S. House of Representatives.” When asked about Indiana’s Religious Freedom Restoration Act (RFRA), he said: “The law permits discrimination, which it should not. It should be repealed.”

When I asked Cicilline about Indiana Gov. Mike Pence’s attempt to “clarify” the new law, Cicilline said, “It’s very hard to enact a law that discriminates against people or permits discrimination based on sexual orientation and then try to clarify that away.”

reject_rfraRhode Island needs to repeal its version of the RFRA (Religious Freedom Restoration Act). We need to do this because our state is the birthplace of religious liberty and freedom of conscience. We need to do this because it is integral to the very DNA of Rhode Island that we brook no persecution or privilege based on deeply held religious convictions.

And if these are not reasons enough, we need to do this for the economy.

When Governor Mike Pence signed Indiana’s version of the RFRA into law, opening the floodgates for potential discrimination against LGBTQ persons, public reaction was swift. An IndyStar headline reads, “Businesses fear costly backlash from new religious freedom law.” The NCAA, Salesforce, Angie’s List and the gaming convention Gen Con are all seriously reconsidering their business relationships with Indiana. George Takei has called for a boycott. And don’t expect Apple to be investing in Indiana anytime soon.

MattielloWhen Rhode Island Speaker Nicholas Mattiello promised to focus on “jobs and the economy” rather than social issues he presented a false dichotomy. The economy does not exist in a socially neutral vacuum. Companies interested in hiring talented people will avoid setting up shop in states with discriminatory laws and practices because social issues are economic issues, and vice versa.

Repealing Rhode Island’s RFRA in this climate makes good financial sense: Just as businesses respond negatively to discrimination and religious zealotry, businesses will respond well to a renewed commitment to equality, freedom and acceptance.

The differences between Rhode Island’s and Indiana’s RFRA laws are mostly cosmetic. We passed our version of RFRA in 1993, and it closely matches the federal law. Since RFRA was passed federally, versions of the law adopted by the states over the last 22 years have morphed from the goal of protecting the rights of religious minorities to allowing religious minorities the right to discriminate based on their beliefs. This is in keeping with the Supreme Court’s interpretation of RFRA, which depended on the law in deciding Burwell v. Hobby Lobby, which granted the chain craft store the right to ignore federal mandates that they believed went against the religious convictions of the company’s stockholders.

When the federal RFRA was passed, it was a bipartisan attempt to strengthen First Amendment protections of religious liberty that the Supreme Court had undermined in Employment Division v. Smith. In that case a Seventh-Day Adventist was denied unemployment insurance by the government because she refused to work on Saturday. When the Supreme Court ruled for the government, there was a demand for greater protections for minority and mainstream religious practices.

Josh Blackman, assistant professor of law at the South Texas College of Law, analyzed the differences between the federal RFRA and Indiana’s and came to the conclusion that “Indiana, as well as Arizona’s RFRAs are very similar to the Federal RFRA.”  The federal RFRA, Indiana’s RFRA and Rhode Island’s RFRA, though different in wording and passed at different times, are not so different in the ways in which they have been analyzed and applied.

Professor Marci Hamilton, “one of the United States’ leading church/state scholars,” has a website that tracks the history of the RFRA laws, and maintains that “RFRAs do not protect First Amendment freedoms. They are extreme, statutory versions of our constitutional rights.”

To the best of my research Rhode Island’s RFRA has not been cited in any RI Supreme Court cases. That isn’t to say that the law has had no effect. Elements of the RFRA can be found in the so-called “Corvese Amendment” attached to the 2011 Civil Union Bill, now invalidated since the passage of marriage equality. The Corvese Amendment was crafted to allow discrimination against couples in civil unions, just as Indiana’s RFRA is designed to allow people in that state to discriminate against LGBTQ people.

As long as we leave the state level RFRA on the books, it will taint Rhode Island’s legislature and judiciary. Rather than protect religious freedoms and freedom of conscience, Rhode Island’s RFRA creates a situation where our laws could too easily be interpreted as a “right to discriminate.” Repealing the law will send a signal to the world that Rhode Island is once again ready to be a leader in true religious liberty. We can show that we are a state of tolerance, diversity and acceptance.

Imagine Apple CEO Tim Cook tweeting about how great Rhode Island is, or Gen Con relocating its gaming convention here. You can’t buy that kind of publicity, but the General Assembly could get it free by simply acting in the best tradition of Rhode Island history and repealing the RFRA.
